  • I've posted a couple of times before so just thought I'd give an update.

    I started this claim several months ago, and eventually started the moneyclaim process at the end of november 06. They acknowledged the claim immediately and stated that they intended to defend it. They had until 28th December to submit their defence and didn't do it so I tried to get judgement against them. The moneyclaim site wouldn't let me proceed with it and transferred the claim to my local court. I received the defence and allocation questionnaire about 2 weeks ago, and sent the allocation questionnaire back on Thursday (11th Jan).

    I fully expected it to drag on for another few months but received a letter from Sechiari Clark & Mitchell Solicitors today. The letter basically states that they will defend the claim but goes on to make an offer of full settlement. :T :T :T :T :T :T

    To anyone out there trying to claim back their charges. Don't give up, don't feel disheartened and keep on going. You will get your money back!

    Total Claimed including court costs of £80 and interest - £1009
    Total Offered including interest accrued since claim started - £1120

    Thanks for the timeline jennie. My claim has followed similar timings to you but is for a smaller amount. Hopefully I can expect a letter from SC&M any day now.

    Just a quick question if anyone can help, have today received the bog standard polite letter from Lloyds saying they are sorry unhappy with charges blah blah but agreed to these initially if not happy with the reply they will help refer the complaint to the financial ombudsman service, where do i go now continue with the next letter giving them the 7 days and do i take it into the local branch again or send it to the recovery centre where this letter has come from in Andover. Any help will be greatly appreciated.
  • Carry on with your next letter and it will probably get dealt with quicker if you reply to the recovery centre.

  • I sent the template letter to Lloyds TSB with a cheque - they have returned the cheque stating:- We are unable to action this request as the Data Protection ACt does not cover Limited Company Accounts.
    Has anyone else had this response?
  • I've never heard that Emdee. Is your account a limited company account then?

    hi just wondering how far people have got with lloyds ours is at court and was granted a stay till 9th jan.... and i called court today and was told its been refered to a district judge....anyone know whats likely to happen next ?

    I would keep checking your bank account as they may just settle and pay the money in directly without informing you - hopefully!
  • Yes and no - I am trying to assist a relative with his account which is in his name T/A as Limited Company.
