    If you have sent them 2 letters previously, now is the time to start the Court claim. Have you been on the CAG website? There is loads of help and support on there, along with template letters, and step by step guides etc.

    Hi, I've just decided to claim my charges back from lloyds tsb. I might sound stupid but do I write to my local branch or the main bank.

    Hi,

    Im new, and have this morning recieved a letter from Lloyds TSB dated 24/05/07 and posted 29/05/07 stating they are prepared to repay me £530 in full and final settlement of my complaint. They state they will credit this within the next 10 days. Great! Only the thing is i used MoneyClaim as LLoyds have been ignoring me and now i have a pending case at Northampton County Court where i am claiming £1018 plus the £120 charge. I dont know what to do next? The claim was issued on 25/05/07 and the court sent it to LLoyds by 1st class on the 25/05/07 and it will be deemed to be served on the 30/05/07. It states the defendant (Lloyds) has until 13/06/07 to reply. Do i wait until Lloyds replies to the court or do i ring up Lloyds and accept the £530. If i do this will i lose the £120 charge already paid? Confused????

    Yes thats their final figure they are willing to repay you so if you accept you will not be able to claim the court fee, the other alternative is to write back to them and say you accept the figure as 'part payment' but you are continuing with your claim for the rest of the money and let the court claim still run that way you will get all that is owed to you, there are template letters in the library for accepting 'goodwill gestures' and 'part payments' and that you are accepting yet persuing the rest of the claim to send to the banks good luck :beer:

    My advice would be to continue with the claim. Let LTSB know you will accept their amount as a partial refund and you will continue to claim for the rest. If you accept the lower amount now, you would not be able to claim later for the remainder and you would not receive a refund for the court fee.

    Hi,

    I have received a reply from Lloyds for offering me £530 but i am claiming £1018 plus £120 costs. After reading about the 2 Lloyds TSB cases I am worried though that i havent prepared the case very well. I used MoneyClaim, did it online but didnt use the templates that were on the Money Saving Experts website, just put basic info regarding how much i think i am owed. I only noticed there was a template to use after submitting it!! I blame it on the chaos in my house with our twin 2 year olds screeching round and our newborn crying for a bottle! As i have now been offered this £530 i am tempted to take it as if it does go to county court my case has hardly any detail just basic "i think i am owed this....." I guess pretty similar circumstances to the 1st Lloyds victory. Did anybody else have victory with just basic particulars of claim?

    There's a certain amount of luck in your situation. If it doesn't get the to the court date, you may well get paid in full. If it does get there and the judge sees the basic PoC, you may well lose.

    Its up to you if you accept the offer from them but should you continue to court you will be asked for further information and at that stage you can then send the court/solicitor/bank the long version of your POC along with your list of charges. You'll find this in the Reclaim Help Thread.
