    An Acknowledgment of Service arrives via the court. So your letter from the bank must be in response to your previous letters and not your court claim.

    MCOL will not allow you to enter a judgment before its time or if an acknowledgment has been received.

    The letter from the tsb did say "they note that i have already started court proceedings and that there solicitors are dealing with this matter".
    What i meant to ask really was, has the bank had 14 days to file an acknowledgment of service or dispute etc and they havent, will i be able to go for judgement anytime after today? If that makes sense..

    Theoretically yes, in reality, the MCOL system is often slightly behind. Oh and sometimes the banks are allowed to file acknowledgements and defences late...

    it said to get it it put in [judgement by default] as you say to the min, so i would do it, the only thing is that some banks are waiting till the last minuate to put in there defence, but according to mcol's rules if it is submitted after 4pm today it will go on as though they have done it the next working day so they would still be too late i will keep my fingers for you

  • Hi, I'm currently using the CCCS to pay back ~£14K of debt which in part is to LLoyds, I want to claim back my bank charges (probably ~ £1000+) but am concerned that this will lead to Lloyds asking for full and immediate repayment of my outstanding debt. My concern is based on the unhelpfullness and sneakyness that Lloyds have shown over the last year or so after I started with the CCCS (who are great and I owe Martin a pint for recommending btw!!!), I was at one time getting ~10-15 calls a week from their various offices demenading repayment of loans!

    If they solve it by the 27th august I'll send them a few photos from my travels... if i mention that in court it's bound to fly by!
