    Hi, This is my first post (although I've been a bit of a lurker for a while!) but need a bit of advice... I thought I was being all clever and read through all I need to do to reclaim my charges, got the statements, worked it all out,sent the letters etc, I filled in all the moneyclaim forms and paid this morning, Then I came back onto MSE and only then saw the post about what you can claim, interest-wise. Rechecking my numbers,I've tried to claim the excess overdraft interest when I shouldn't (I haven't claimed normal o/d interest) but have already started the mcol process! My question is.. should I redo all the numbers and rewrite to the bank with a new, lower figure, admitting the mistake (and then cross my fingers) or shall i wait til tuesday and try to cancel the moneyclaim and start again, although if I do this do I risk losing my £120?
    I'm kicking myself, I thought I had been so thorough reading everything and completely missed the contractual interest bit!

    It is a bit of a grey area as technically interest paid on an unlawful charge is reclaimable. The difficulty arises when trying to prove it.

    My first thought would be to not change anything yet and see if the other side or the judge pick up on it. You can always amend your claim later. There is nothing that specifically states that you can't claim it so you aren't being dishonest in claiming for it.

    Is that 28 days from now? or when it was served on the 13th may?

    dont worry I,ve done exactly same thing....but am going to wait till Lloyds put a defence in then when it gets to the further POC I may add it in or on advice I may go for amendment to claim, you can phone mcol about this, they do help, if you decide to go for an application to amend the fee is £35.00.

    If you settle you get what they are offering, no more no less. So basically you will lose £450 + £120 = £570

    As to whether you continue or not, well that's up to you. No-one here will make the decision for you.

  • Has anyone had this before once they have served notice from the court on the bank? And has anyone continued to take the bank to court?
