Well I don't know what to do if i'm honest - my wife said take the money, but, I want to take it further but I will have to wait until i've got enough money to do the court claim so the 10 days will elapse I suppose. But I could just send a letter saying I do not accept this as final settlement and am going to proceed to court.

I do not know how court view your case if you have been offered a lower settlement?

I would send a letter stating that you will accept as part payment only and carry on to court for the rest. their offer was only about 60% of your charges. If you accept the offer you will be kicking yourself later!

There are plenty of people in the success thread who accepted as part payment and got the rest through the court so i dont think it makes any difference to your claim.
But only you can decide if its worth taking them to court for.

    GOOD LUCK

What was the date of judgement entered? And what address did you enter as the defendants address? I used the Andover address and it appears that, due to the back log it is taking the andover people time to forward the details to the solicitors. I just keep ringing the solicitors (01273 205381) as they seem helpful. Although I do remind them that they have until next Wednesday before the warrant is issued...
    :T
The date of Judgement was 16th May and i also sent it to the andover address. I sent a special delivery Yesterday which has been delivered asking for the payment in 10 days or i will issue a warrant.

I've started making a claim for charges from my bank, Lloyds TSB.

1st I requested a list of charges made over the last 6 years with a £10 cheque. This was sent to my local bank.

I had a reply from the Copy Statement unit, Birmingham. Listing the charges made since 1991.

2nd I sent the next stage letter requesting a repayment of all the default charges and my copy of a spread sheet of the charges. This was sent to the Head Office, London.

Now I've had a reply from the Customer Service Recovery Centre, Andover. This basically saying they have to make charges when customers have not enough in their account and it means extra work etc. So its not unfair for them not to do so. Also garbage about I have concerns about 'White Data' and if I've asked for copy statements, to send a £10 cheque. But to Statement Request, Andover. When I've already got them from Birmingham.

    1) Should I now go on to stage 3, threatening with court action, etc.using one of Martins templates as I've done up-todate???

    2) Where should I send it to, Andover, Birmingham, London Head Office or my Local bank. ??

    Confused

To work out the daily interest, multiply the amount of your claim (charges only, not including interest) by .00022.

You need to go the letter threatening court action and send this to Andover, but make sure you stick to the required times ie. 14 days. Beware that LTSB may send you letters which they back date, I received a letter on the 11th of April which was marked 30th March.

Good Luck, I'm waiting for them to defend against my court action.
