    OK, I've got to the stage of sending Lloyds a second letter, threatening court etc. Had no response, so now I am thinking of writing a letter saying I am now going to commence court proceedings, trouble is I can't actually afford it at the moment. I get paid Friday, but I don't think I'll actually be able to afford it until the end of June. Is that a bit iffy??

    Hi have you tried the ombudsman just an idea if you carnt afford the courts i am in abit of the same situation i applied with lloyds 20/04 then a second letter on the 06/05 still no reply but i sent a letter to the ombudsman and i should be hearing fromthem soon but if i dont have any luck with them then i will have to take it to the next level

    how do some people get to claim back £1000's

    They get charged £1000's.

    Read the Success Stories thread. Loads of people have had successes with Lloyds TSB. OK, its not a 100% record, but they are working on that. The court involved shouldn't make any difference.

    What was the date of judgement entered? And what address did you enter as the defendants address? I used the Andover address and it appears that, due to the back log it is taking the andover people time to forward the details to the solicitors. I just keep ringing the solicitors (01273 205381) as they seem helpful. Although I do remind them that they have until next Wednesday before the warrant is issued...

    I'm at a similar stage to you, I received my Notice of Transfer of Proceedings dated 8th May. And yesterday got my court date 29th June!
    Should not be too long now hopefully.... mine is for a piddly 170 squid why are they making this cost so much more than they have too?

    Hello again!

    Well, i'm in the middle of claiming back £1270 / £1386.65 with interest from Lloyds.

    Got to the letter stating i'd take them to court in 14 days.

    Got back repsonse saying sorry chum, terms and conditions etc.

    Looked into court after about 25 days in total since threatening them. Found out it would cost £120 to go through with it, but i'm totally skint and couldn't afford it so thought i'd leave it until my RBS money comes through (they just offered me £3500).

    Didn't do anything else, but today I got a letter from Lloyds saying 'Thank you for getting in touch again and we're sorry you're still unhappy with charges... blah blah... Generally we don't agree to adjust any of these charges, but I can tell you that on this occasion we are prepared to pay you £750.00 in full and final settlement of your complaint.We will credit this to your account in 10 days, and we will also cancel all charges we may have told you about but not taken. Please treat this letter as our final response, this means that if you're still unhappy, you can ask the Financial Onbudsmen Service to investigate your complaint."

    Now I have no intention of accepting anything less than the full amount. I don' tknow how they got to this stage without any further action from me, maybe it's because I just opened a business account with them. The question is, what do I do now?
  • I have received the same response & offer of £750.
    Are you just going to pursue the claim for the outstanding amount.
    They have mentioned that the money will be credited within 10 days.
    Im thinking it will be longer than that for them to respond to a letter requesting the full amount/court action?

    Well I don't know what to do if i'm honest - my wife said take the money, but, I want to take it further but I will have to wait until i've got enough money to do the court claim so the 10 days will elapse I suppose. But I could just send a letter saying I do not accept this as final settlement and am going to proceed to court.

    I do not know how court view your case if you have been offered a lower settlement?
