Hi, Had a letter from the court today, "the Claim is stayed until further order"
No application to lift the stay will be heard unless the claimant files amended particulars of claim."
does that mean in laymans terms that I need to send all my statements to the court? I would appreciate any help here
    thanks

After submitting your claim form, they get so long to defend. It sounds like they've defended and therefore a hearing has been listed. You should have already filled in an allocation questionaire as I think they need this to list a hearing (it asks things like which track you want to use and how long you think the case will take) but seeing as you say you've had no other paperwork I think you may not have received something you need. Also if they have defended then you should receive a copy of their defence. If it were me I'd get onto the court first thing Monday morning (first thing being 10am for the courts!)

hi again. i have received a copy of the defence and it says the judge has considered the statements of case and the allocation questionnaires filed and has allocated it to the small claims track. It also says i need to issue all documents i intend to use.
I am extremly confused. I have only filled out forms on mcol and does this mean i send ltsb copies of my bank statements?
Am rather scared by all this

    Hi Emma,

I am in the same position as you. Put my claim in 23rd April, acknowledged 11th May, almost at deadline, and nothing from LTSB or the Sol's. I am assuming they ackowledged, just to bide time. My claim is for £288.00, nothing by other people's standards so fingers crossed I slip thru the net when it comes to defending the case. Deadline is Bank Holiday so they have an extra day which is terrible really cos if the cant get their act together by the 28th day then tough!!

Best of luck with the baby

    Hi given up,

I completely forgot about bank holiday, which means i have to give them an extra day too. my claim is for just over £3000. although my account has been running well for the last year these are all charges from a couple of years ago - usual story of going overdrawn because they had taken the charges out that i really couldn't afford. I am in the process of changing bank accounts because I really do not like banking with Lloyds anymore, they are so unhelpful.
Good luck with your claim, hope all goes well.

    Baby hasn't arrived yet!

LTSB have put in a defence to my claim. Was contacted by them on Friday, not the solicitors, and was told that they think I am only owed £400, not the £4,603 we are claiming for, and that they would settle at that. Told the idiot I would see them in court and asked that they file their paperwork asap as I don't want them to stall on this part.

    Is this a new tactic?
