Also claim is likely to be over £5000, too much for small claims court. What should i do?
    any advise welcome

Start off your claim for 6 years and send off the letters as per Martin's step by step guide. If, as is likely, you get nowhere with the first letter and the letter saying you will take them to court then you can hand it over to the Financial Ombudsman who will deal with your claim if you have been trying with the bank for 6/8 weeks. There is no limit doing it through the FO.

Apologies to those people in this thread with posts about Yorkshire Bank as due to a glitch in the site the threads were merged and I am in the process of re-starting the Yorkshire Bank thread again.

I put my claim in on MCOL on 27 April, they acknowleged on 9 May - and I haven't received any letters from Lloyds or their solicitors - has anyone else had this? And are the majority or people getting this £750 goodwill gesture?

They haven't defended yet, but not holding my breath for them not to, by the sounds of it they always do it at the last minute.

Baby due tomorrow! at least it will stop me obsessing with the HMCS wbsite to see if they've defended!!

    Hi Emma,

I am in the same position as you. Put my claim in 23rd April, acknowledged 11th May, almost at deadline, and nothing from LTSB or the Sol's. I am assuming they ackowledged, just to bide time. My claim is for £288.00, nothing by other people's standards so fingers crossed I slip thru the net when it comes to defending the case. Deadline is Bank Holiday so they have an extra day which is terrible really cos if the cant get their act together by the 28th day then tough!!

Best of luck with the baby

I sent 1st letter off and had a reply 4 days laters saying they charge for some extra services. They also go on about default charges for people breaking an agreement with them. They say my charges are not default charges as I haven't broken my agreement and the charges are the prices for the service they provide in these situations. When I started the account they would not allow me to have an overdraft. In the end they had to agree to a temporary overdraft as they wanted one month to take £200 charges out. Ive looked at my overdraft agreement and wonder whilst it states they will charge me £35 etc it does not state this is for services. Are they just trying to get me to back down and should I continue with my claim????

I have recently received this letter from them to, but i still have a copy of one of the letters that they send you when you are notified of the charge, which quite clearly calls it a charge for going over your limit rather than a charge for a service that they provide due to you going over your limit.
Because i have this letter i am positive that the letter that both you and i have received for them of late is just a way to try and stop you going ahead with the claim. The charges that you have received from them in the past are no different from anyone else and this is just their way of trying to put you off.
Carry on going through the steps on this sight and hopefully we'll succeed.
    Good Luck.

Hi all, Have just had reply from lloyds tsb they have offered me £750 as a final settlement. I am tempted as I am really hard up but this is half of what they owe me They have sent me details for the Financial ombudsman as the will not reply to any further corries from me. Do I stick it out or what? regardsX:eek:
