i got judgment issued 9th may - on the 15th i sent the following letter (dont forget your name address and claim number)
claim no - xxxxx
dear sir/madam
Please find attached a copy of the judgent i have gained against your client lloyds tsb.
I am writing to request that you pay the full amoutn of £xxxx into my lloyds tsb account by "date" (give them 1 week from judgment being issued), my account number is xxxxxx sort code xxxxx the account is held at "name of branch" or by cheque made payable to myself to be received in the post by the above date.
I have sought legal advice and have been advised that should you fail to pay the moneys in the time I have requested I am within my legal rights to reuest thecourt to enforce the outstanding judgment without further notice.
accordingly I look forward to receiving reimbursement of my funds to prevent enforcement action.
I look forward to your prompt reply by either tel on xxxx or email on xxxxx

I then rang them 1 day before deadline, to be told it would be in account within 5 working days.
I then faxed them the below letter
Dear Sir/Madam,
Further to my recent telephone conversation with "persons name" at "time" today I am writing to confirm that i expect payment for the fll amount of £xxxx paid into my lloyds TSB account number xxxx sort code xxxxx within 5 working days as advised.
I had originally requested payment to be in my account by "original date", however in this case i will extend that to "new date"
Failure to recieve the funds will result in enforcement action without further notice.
Should there be any problems i will expect a telephone call by "date which is 3 days prior to money supposed to be in account by" on tel no

**** i faxed this at 3pm this afternoon - got home at 7pm and money was in account****
all of that ive typed is all the proper legal jargon, my good mate works in solicitors and checked all my wording so that it was all correct.
THESE LETTERS ARE TO BE USED ONCE YOU HAVE JUDGMENT ONLY

Hi all, just received a copy of the defence from Lloyds TSB and notice of transfer to my local court, getting a bit nervous now, especially after that guy losing his case. What do I do now? Do I have to return anything? or is it a case of waiting for a court date? Thanks!0

Just to let you know that it is important you get your T&C in your bundle.
Now my question would be do you go back and get the Terms and Conditions from the year you opened your account or the ones out now because they will differ. I'm sure that the terms and conditions of ten years ago will not list going over draw as a service as they do now or do they?. Please help. I found out i opened my account in 1994. To get your T&C you have to go into your branch and ask for a print out.

My son has just got his court date through - mid February.
Helen: It's well known that Lloyds usually take it to the court steps before they finally settle in full. Was that your experience? Did they settle in full or did you accept an 'offer?' The reason I ask is because I thought my son may have heard something from the solicitors by way of an offer (not that he is going to accept - holding out for the full settlement!)

Woo I filed my claims at local court on tuesday. I have received notification this morning of the claims, Lloyds have until 1st June to respond (hope I slip the net :rotfl: )

You were really lucky, I'm put my claims on MCOL on the same day as you £170 and £750 and they defended and I'm still waiting for judgement from my local court:mad:
It does give us all hope though when we see it goes well for others

I started mid january and have stuck to all time scales even borrowing money from my mum to pay for MCOL so its not that i've stopped and started. In my first letter i asked them for 1/2 of charges for quick payout, 2nd letterasked for all of it and then obviously now at court stage want the interest too. You know i am fed up with this cause when they take your charges they give you 14 days not 7 months to put the money in, and i tell you what when i get in that court room i'm gonna take evidence of how inconsistant lloyds are with these claims, why is there no 1st come 1st served
sorry i don't mean that against our fellow claimers but when you haven't recieved this £750 and some have youhave to ask why??? don't ya
i know how you feel,i started my claim in march and i was claiming £964
and i would of settled for the £750!

I have started on mcol, lloyds have til 30th may to defend, acknowledge etc, i have had no offers just a letter yeaterday saying sorry you still feel this way, but note you have started legal action, it is now in the hands of our solicitors, any chance of any offers at this stage do you think, keep checking my bank acc just in case!!!! lol0

how can they manage to defend all their claims i'm not sure they even will because almost every minute people put claims through they seem to be waisting time. Oh well serves em right for pulling a fast one0

Thanks - i know i got really lucky - cant belive it really :eek: - but still logging on to help when i can
most is spent on paying debts!! but at least i get a fresh slate.
