    All banks have set up departments to deal with these "complaints" its very unlikely that any branch manager will be in a postition to deal with this.

    i put in my claim to mcol on the 11/05 and on the 16/05 i got a letter back from lloyds saying that they beleaive ther charges to be fair as they have to do more work when they pay for my dd. is this just a standerd letter.

    one more thing my sister was telling me that someone lost, it was in the sun or mirror 2 days ago. i am abit worried as i have got to this stage i'm not to sure what to do next lloyds have till 30/05 to reply they where served on the 16/05 your help would be greatful.

    great news about your win, did you ever get a letter after you put in to mcol from lloyds saying that they beleive there charges to be fair, as i got one yesterday bit worried i'm not going to get my money, can you help

    Hi all Just started out on this. I have sent an estimated claim for just over £2000. to TSB they reply'd with the standard letter 4/8 weeks. second leter said that charges were legal so no payout.:mad: Question is can i go to court with just an estimate or do i have to get all my statements. I have 12 months. and if i get the statements and they show only £1500. do i have to start again. Also if i want to claim interest with out the statements i dont have the date's to start from. Thanks for any help.

    no i didnt - i wouldnt worry there prob just sending random letters to people at mcol to try and put frighteners up them cause of that 1 case they won - dont fret stick in there

    I am not an expert but you can't claim on an estimate. As you say it may not be as much as £2000 and if you have no proof how can you take that to court? Anyone could claim for any amount they felt.

    However you can go back a few years on your internet banking but it won't be 6 years. If you get your statements and find the amount to be less then yes I suspect you will have to start again.

    Im still waiting to receive my judgement (requested in person) on 9th May, court has a big backlog!

    Thank you for getting touch with us. I am sorry to hear about your account charges.

    Like any business, we do make a charge for some of our extra services. When customers don't have enough in thier accounts to cover a payment, this always means extra work - and it has to happen very quickly. We have to agree to make the payment by setting up or increasing an overdraft, or tell customers that we can't agree it. We feel it's fair to charge for this service.

    Of course it's only fair too, that we're completely open about any charged for services before you might need them. That's why we take care to give every new customer the latest guide to our charges. You can also get up-to-date details about fees and borrowing rates from our branches, internet site blah blah blah.........................

    Just as importantly, we do everything we can to help our customers avoid these charges. You can get up-to-date balance at any of our cash machines, over the phone blah blah blah.....................

    If you know a payment is going to take you over your agreed limit, you're welcome to see if there's anything we can do.

    The office of Fair Trading has published new guidlines on credit card default charges. We're still talking it through with them, but the important point is that the guidelines are about 'default' charges that people pay when they break an agreement with us. This doesn't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you haven't broken your agreement. They are our prices for the service we provide in these situations.

    I do hope you can see that we make our charging system as fair as possible - and why I can't agree to cancel your charges.

    If you have asked for copy statements and paid the fee, we'll send them to you within the 40 day limit set by the data protection act.

    If you have not yet sent the £10 fee you will need to send it to us at the address below. The 40 day limit starts from when we receive your payment Please quote the reference number shown above when you send your cheque to us.

    I hope this fully answers the points you raised with us. Please let me know if there is anything else I can do to help. If we cannot come to an agreement, I will provide you with details of the Financial Ombudsman Service so they can consider your complaint independently.

    If you are happy with the way I have dealt with your complaint, there is no need for you to reply to my letter. If I have not heard from you by 10 July 2007 I will close my file, though of course I will re-open it should you come back at any point afterwards.

    So guys, what do you think about that? This came after we sent the second letter with the charges + interest included.

    Do we carry on regardless and send the letter threatening court?

    Looks like it's going to be a long drawn out process!?
