I put my claim in on MCOL on 27 April, they acknowleged on 9 May - and I haven't received any letters from Lloyds or their solicitors - has anyone else had this? And are the majority or people getting this £750 goodwill gesture?
They haven't defended yet, but not holding my breath for them not to, by the sounds of it they always do it at the last minute.
Baby due tomorrow! at least it will stop me obsessing with the HMCS wbsite to see if they've defended!!

i got judgment issued 9th may - on the 15th i sent the following letter (dont forget your name address and claim number)
claim no - xxxxx
dear sir/madam
Please find attached a copy of the judgent i have gained against your client lloyds tsb.
I am writing to request that you pay the full amoutn of £xxxx into my lloyds tsb account by "date" (give them 1 week from judgment being issued), my account number is xxxxxx sort code xxxxx the account is held at "name of branch" or by cheque made payable to myself to be received in the post by the above date.
I have sought legal advice and have been advised that should you fail to pay the moneys in the time I have requested I am within my legal rights to reuest thecourt to enforce the outstanding judgment without further notice.
accordingly I look forward to receiving reimbursement of my funds to prevent enforcement action.
I look forward to your prompt reply by either tel on xxxx or email on xxxxx

I then rang them 1 day before deadline, to be told it would be in account within 5 working days.
I then faxed them the below letter
Dear Sir/Madam,
Further to my recent telephone conversation with "persons name" at "time" today I am writing to confirm that i expect payment for the fll amount of £xxxx paid into my lloyds TSB account number xxxx sort code xxxxx within 5 working days as advised.
I had originally requested payment to be in my account by "original date", however in this case i will extend that to "new date"
Failure to recieve the funds will result in enforcement action without further notice.
Should there be any problems i will expect a telephone call by "date which is 3 days prior to money supposed to be in account by" on tel no

**** i faxed this at 3pm this afternoon - got home at 7pm and money was in account****
all of that ive typed is all the proper legal jargon, my good mate works in solicitors and checked all my wording so that it was all correct.
THESE LETTERS ARE TO BE USED ONCE YOU HAVE JUDGMENT ONLY
hope this helps everybody - it certainly helped me - my friend sent same ones a day after me so will ring her tomorrow to see if it worked for her

Sent 2nd letter to TSB to request refund, any feedback on how they are at responding?
Believe they have 14 days, how have others got on?
Reclaiming £4415.49, how hopefull, I dont know what to expect.
Any feedback appreciated.

I've sent off my second letter requesting them to pay back all default charges. (O/DRAFT EXCESS FEE). They replied: "The guidlines are about 'default' charges that people pay when they break an agreement. This doesn't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. (I never had an agreed overdraft). They are not default charges beacause you haven't broken your agreement. They are our prices for the service we provide in these situations"

I just registered there last night, and oh boy it has nothing on this site...there was a post on there...If you waiver the 8% apr on your claim you will NOT get your money back as the bank will think you dont know what your doing....what utter rubbish...I cant believe some P***k could even suggest that...you dont have to go for the 8% apr on your claim if you choose not to..it also doesnt mean you,re stupid or gullible, as long as you present your claim as to why you,re not going for the 8%apr bears no difference as to wether you will win or lose....Personally I chose not to claim the 8% apr up to judgement because I would be happy with the charges reimbursed plus interest applied to those charges.. and personally for me I think that is, a fair and just claim..for those of you that wish to go for the 8% is entirely up you and not some unsolicited twit to suggest otherwise...like MissC i too have access to legal advice thru a trusted friend of over 30 years, she is a litigation specialist, keep your particulars of claim to a minimum of wording then when a defence is put forward..attach a further additional particulars of claim to the court and/or solicitors/bank, in writing along with your claim number...Albeit...for those of you that wish to do one or the other does not harm your claim and congrats to those that have gone for the 8%.
Stick with mse its the best site here altho cag does have some good templates and future communication, but i think mse is the best.
