I have recently received this letter from them to, but i still have a copy of one of the letters that they send you when you are notified of the charge, which quite clearly calls it a charge for going over your limit rather than a charge for a service that they provide due to you going over your limit.

I'd be interested to hear from anyone who has successfully gone to court with Lloyds TSB since that win in their favour last week. I have just sent them a letter for the second time asking for around £2000 in unlawful charges back and i'm really not sure now if i want to go through with it, so it would really help if i knew of someone that had got their money back from them since that case.
    Thanks.

One thing i find really interesting with Lloyds is that in their details on account charges they do actually state that charges won't be over £90 a month! I personally have been charges £120 twice on my accounts in 2 consecutive months. Is it just me or is this breach of contract by Lloyds? Anyone with a legal brain let me know!
    Thanks
  • Hi there,
    Can anybody help please?
I'm now at the stage of talking Lloyds TSB to court. Was a bit concerned about what happened the other day when Lloyds won their case. After reading Martin's updated article, am still going ahead with my claim.

Have just got a couple of queries though. With my last letter I sent off photocopied bank statements with highlighted charges. Is this the same as sending a schedule of charges? Plus I have left it longer than 14 days. Will thes affect my claim if it goes to court.

    Thanks

llloys never bothered to defend at the mercantile court with me, they could ahve got this stopped once and for all but didnt bother

Kellymundy dont bother with thier internal policies, they probaboy have a disclaimer somewhere saying they reserve the right to alter these AT any time

I received the same letter and it seems like this is Lloyds new way of trying to get out of refunding excess charges. However the impression I got was that no matter what they call the charges they are still excessive and if done in the right way should still be able to be reclaimed.

Here's the link for the good advice I received from my posting:

PS You would be over your agreed overdraft limit if you didn't have an overdraft and went overdrawn (if that makes sense?!)
