  • Hi all, quick question: are Lloyds closing bank accounts? I am reclaiming for my boyfriend - has he has 2 accounts with them and a loan. Will they close the accounts and call in the Loan if we successfully reclaim money from them? I have hunted about but cant find the answer to this anywhere? xx thanks guys

  • As you have tried phoning and it didn't work you can try sending the first letter asking for them to refund the charges.
    sorry but what is the first letter and I will have to wait till the money comes out of my account??

  • Hi, any advise would be great. I sent the letter off to Lloyds requesting a refund of charges and they sent a very nice/polite letter back with the usual blurb about charges being for their services and that that they can't agree to my request to refund my charges and that if I want to take it any further I would be referred to the FInancial Ombudsman Services for independant advise.
    Help, I don't know where to go from here and I want my money back.

    I received that letter also, its just a way for the banks to try and get out of being taken to court - still carry on with proceedings

    No you don't need to wait until the money is out of your account as you have been told that it will be charged. If its the only charges you have had you could adjust the letter to say that this is for charges about to be debited to your account.

    Rec'd letter this morning from Lloyds basically saying they can charge the charges etc etc and the usual "will help you refer to Financial Ombudsman" etc.

    Going to now send the letter threatening court action, where u have to fill in the name of court, do you put your local courts? Magistrates closest to me ??

    It will be the name of your local county court (not magistrates). See post #6 in THIS THREAD to find your local court.

    On the Consumer Action Group site,

    there is a reference to RIGHT OF APPROPRIATION which if I understand correctly means YOU get first dibs on your benefit and the bank cant take their charges out of it. The thread also notes that the DWP may be able to have some influence on grabbing it back if the bank have already done so

    if i may reproduce a few lines -
    "there have been several reported cases of Banks taking charges from accounts that have benefits paid into them by DWP and Social security.thus leaving them with little or no money.
    (t)Here is a template letter to take or send to the bank to address this.
    It is important to let the bank have this BEFORE you expect to have funds paid in by DWP or the Inland revenue.
    A new letter should be sent for each payment that you expect to be protected,customise as required by adding the benefit/type of payment."

    which clearly points out that -

    "Even if your account is overdrawn, you can choose how any further money you pay into the account is used (for example to pay your mortgage or rent). This is called first right of appropriation. You'll need to write to them with new instructions each time you make a deposit."

    just wanted to ask a quick question, i am in the process of getting the first letter to the bank and was just wondering as i walk past my local branch every day can i just pop it through the letterbox or is it best to post it recorded delivery so you have proof they received it:
    any help would be appreciated
