I have started court proceedings but have come home to a £750 offer from TSB. I am claiming £2200.
They say £750 will be in my account shortly.
I want to carry on with the proceedings.
What do I do?
Do nothing and let the court situation take it's course? If so, do I have to contact TSB again? Or, when the £750 goes in the account, is that the end of it...game over.0 -
I would go back to them and say you are accepting the £750 in partial payment of your reclaim but your court proceedings are going ahead.0

I went over drawn on an account just before christmas for £35 for 9hrs because a money transfer hadn't gone through from another bank. when I discovered this I topped up my account. however I soon got a letter telling me they are going to charge me £35. so I have politly rang appologised and asked them not to charge me. It went to 3 diffrent departments and today I got a letter say they were ever so sorry but the wern't going to waiver the charges. What do I do now because the money has actually come out of my account yet. Do I have to wait until it does before I take further action? If so what action do I take. My husband has had an account with this bank for £25 years and i for 14years and never been overdrawn you would think this would account for something.HOW MUCH ?0

As you have tried phoning and it didn't work you can try sending the first letter asking for them to refund the charges.0

Evening all!
In response to my initial letter for repayment of bank charges, Lloyds have replied with a bog-standard response letter.
A couple of quick questions:
1) As I applied to recover my charges at the same time as my wife did on her account, to keep our initial costs down, do you think that we should combine the total amount due into one court action (they owe us approx. £4200), or should we do it separately?
2) Should I reply to their standard reply, giving them 7 days, or just go for the court action?0 -
Well, again I'm upset, angry and shocked.
Today I came home to another letter from Lloyds.
Charges for the period 2December 2006 to 2 January 2007
OverDraft Interest £0.14
OverDraft Excess Fee £90.00
Unpaid Standing Order £35.00
Total £125.14
I'm really stuck and don't know what to do. The last time I called them they said there was nothing they could do about it.
I do not have an overdraft so really they should not be letting me go overdrawn....I cancelled the DD and SO because I knew there was not enough money in there but it seems I cancelled them too late.
How can they keep doing this to me?
They know I'm on low income yet they are putting me further into trouble with their stupid charges. I have no money, I can't pay my rent and I really don't know what to do.
If anyone has any advice, please let me know.0 -
Hi, any advise would be great. I sent the letter off to Lloyds requesting a refund of charges and they sent a very nice/polite letter back with the usual blurb about charges being for their services and that that they can't agree to my request to refund my charges and that if I want to take it any further I would be referred to the FInancial Ombudsman Services for independant advise.
Help, I don't know where to go from here and I want my money back.
Thanks0 -
This is a standard reply so just carry on with the next letter.0

I am quite worried as I have my court date on Tuesday but totally forgot and have not sent in copies of my documents. Have I made a huge mistake???
I should have sent these in 14 days before the hearing
Also, Being only 4 working days before the actual date I was hoping that Lloyds would have paid up by now. Have they gone the whole way?0 -

Go over to http://www.consumeractiongroup.co.uk/ Register there (it's free like this site). You need to download the court pack they have prepared. Print this out (it's a few pages). Read through the forums there to see other peoples experience. They have a Lloyds board, this may be a good place to start reading. Read as much as you can, and try to understand exactly why you are claiming and the law behind it, and why the banks have acted unlawfully.
There is still a very good chance that Lloyds will make a deal on the steps of the court before you go in to see a judge. There is also a chance that they wont turn up, in which case you will win by default.
You need to go to court though. Tell the court that you are not 100% familiar with the court process, and this why they haven't received any documents, but you have them with you.
It's most important that you try to understand the law behind this claim before you go to court. How many surrealists does it take to change a lightbulb?
