    Ive been writing to Lloyds Tsb since 29th March 2006 and have not got anywhere as they refused to refund anything, i then wrote to the FOS at the end of July to which i have only just recieved any letter regarding Lloyds Tsb as they were writing every to 30 days to say they were waiting for Lloyds Tsb to get in touch. I got the latest letter today to which its says lloyds Tsb are offering to refund all my charges after 7th Jan 2003 which they claim to be at £170 i have a list of the charges applied after this date and have a figure of £314. I also have a number of charges prior to this date which total to £229 . The FOS have asked me to consider this offer but i dont really know what to do as this offer is way below what i am owed.

    Any one been in the same situation?

    If I was you, I would follow the steps in Martins article. You can skip the first letters, and use the template letter to write to the bank giving them 7 days to settle in full or you will issue a court claim. If they refuse, go to court. This will produce a far speedier settlement of your claim, and you will be more likely to be paid in full rather than than only getting part of your charges back.

    The FOS doesn't have the same power as a judge to rule over the lawfulness of these claims, and the banks know this.

  • Thanks very much for that!! I have totaled up all the charges with intrest and will now type the letter up. I wish i had not accepted offers from the other banks and gone legal with then to but hey this is the last of the gits now!

  • Letter done now, Just needs a stamp. Hopefully ill get the money back as its about £700 could use that to pay off a credit card. Also done a letter for Barclays who i currently bank with as i been charged £30.00 twice in the last few months, but this was a polite one not nasty.

  • Earlier last month, I set up a savings account with Lloyds TSB.
    I only wanted to send £25 over to the savings account at the end of each month, via standing order. Just a little amount to help me renew my football season ticket.

    Sadly, with last month being Christmas, my account only had 70p in it at the end of the month!

    I received a letter today telling me I have been charged £35.

    Can they charge me for not paying into my own savings account?

    Would kicking up a fuss get me anywhere?

    Kick up a fuss! They won't refund the charge unless you do.
    My sister, a debt counsellor for a housing association, called Lloyds last month on behalf of an elderly client who had marginally exceeded a small overdraft and been charged. She succeeded in having the charge cancelled immediately.

    hi everyone,
    i have been looking at the forum for a while and just keep thinking they won't pay me back, or i will be the first one they take to court and i will lose all the doubts:D but i am going for it as they must owe me at least 5000 as i had a bad patch lasting about 3 years due to a failed business and their dd fines were taking me overdrawn so the next dd's would not go through (vicious circle),
    i had this argument for years with my local branch manager how do they warrant £35 to press a computer button to see if money is there,
    anyway this has probabaly been asked many times before but i have got to try a shortcut while i am in the mood,the question i wanted to ask is what address do i send the first letter to asking for the statements etc and would a p/o do for the £10 payment

    any help would be appreciated

    Dear All,

    I actually ask this on behalf of a friend as having been a member here and read many posts I thought you may be able to help.

    My friend is currently not working and therefore every penny counts. He had a standing order/direct debit set up to go out (i.e. monies to leave his account) on the 1st of each month. He called the bank up the day before i.e. 31st to cancel the DD/SO. They stated that it had been actioned. He then found out on reading his bank statement which arrived this morning that the bank had charged him £35 as they stated that it was too late to action the cancellation although they didn't actually say this when he called them originally - and now obviously there isn't enough money to pay what he owes.

    Do you think he could reclaim this? Is so what is the best way to go about it? He does not really need to risk having his account closed as he has bad credit which he is trying to repair. What's his position on reclaiming the bank charge?

    Any advice would be truly appreciated.

    The bank are correct, you can't cancel a DD the day before it's due out. Usually for some reason 3 working days are required. If they failed to tell him this, then it may be a good idea to point this out in an initial telephone request for the refund. If they refuse, you will need to start the process. There is no guarantee that the bank would not close his account though, so he needs to consider this and act accordingly.
