Is it worth pursuing the card department on their own? Has anyone done this and been succesful? I am kind of tired of all the to-ing and fro-ing and am tempted to stop now but if I thought it was worth it I may find a second wind...

It sounds like you are making seperate claims which is correct. You can pursue the credit card company even if they pay up for the current account. By the sound of it, you will have to file a court claim, as they won't play ball, but you'll get your costs back plus interest if you win.

    Thanks Nickmack.

In hindsight I think I may have made one claim but we got there in the end. I think as I am doing it on behalf of someone else it isn't quite the same but I may just see. I haven't been able to see any success stories for the credit card dept..may keep looking.

Wife just phoned me to say that a letter has arrived from the courts with the AQ etc.

Will fill this in tonight and send it off first thing in the morning. Getting closer to getting my money back!:money:
  • Maniac, thanks for this I appreciate it.

I've been looking through a lot of the posts and it looks as if i was one of the worst personal bankers ever with the amount that I am claiming. Does anyone know if the amount of money being claimed makes things quicker or more complicated?

Got home last night and filed in the Allocation Questionnaire which was really simple thanks to the great help available on here and on the CAG forum.

I'm not sure what to put in section G though, if anyone could help I'd be really grateful.

Also do I only need to return this to the court or do I need to send one to Lloyds too? And, do I need to enclose my schedule of charges?

    Thanks

For section G, you have a couple of choices. Over at CAG, they have some suggested wording for this on their guide to completing this form. There is also a different idea for this posted in THIS THREAD. This second suggestion looks very good, but requires a bit more understanding and work on your part. I would recommend the second suggestion, but I also recommend you read up and understand what this requires of you.

    Thanks Rex

After careful consideration I hace decided to follow the new strategy and send the bank a draft order for directions.

For all those that are nearing the same stage as me, the AQ stage is not that scary.

I was not looking forward to receiving the AQ let alone filling it in, but thanks to the great help on here and the CAG website I found it pretty straight forward.

I'm also going to send a copy of my AQ to Lloyds solicitors.

    Shall I just write a brief letter such as;

Please find enclosed a copy of form N149 Allocation Questionnaire (Small claims track) that has been completed in respect of the above case. (case no put as reference at top of letter)

    Yours sincerely

You don't need to send a copy of the AQ to the banks solicitors. This form is for the judge to decide how your case is going to be dealt with, and whether any he is going to make any orders for disclosure. Sending a copy to the solicitors will do nothing.
