I'd write another letter giving them 14 days to respond, at which point you will be taking them to court.

We are getting ahead of ourselves a bit here with the MCOL online claim form, but I regret that the chances are that the bank won't cough up after the second letter. Whilst taking a multi-national corporation to court is not to be entered into lightly, you do also have your right to justice. The MCOL claim form wasn't anywhere near as bad as I was expecting - and nowhere near some of the online job application forms I've had to fill in! Also the articles and forums contain all the information you will need.

I'm not sure I can argue my case in the formal surroundings of a court. My orating skills are not exactly brillient!

Thanks for the vote of confidence but I'm still bricking it! :T :T :T

Has anyone got any good tips in the event of going into court and how do the proceedings take place?

Don't worry, if it gets to the court date they won't turn up. Use the court bundle from the CAG website.

    Good Luck.....

Thanks for the vote of support, as they have acknowledged they know have until June the 4th to defend, and I go on holiday on the 8th for 2 weeks I could have done with the cash.

    The news link is excellent..

I've just faxed Lloyds solicitors a very nice letter giving them until friday to pay up otherwise bailiffs - will see outcome - not holding breath - got my soliictor buddy to check it over so all legal jargon is there - if you ever need any copies of my letters etc just pm me and i'll send it over

fingers crossed for you - will be a good outcome if they dont defend and you can get judgement before you go away

  • Hi, i'm after some advice please if anyone could help.
I sent of my first letter to requesting my bank statements on the 6th march, allowing 40 days for the bank to get back to me.
I recieved a reply from the bank on the 28th march, saying that they would send my statements within 3 weeks.
As of today i am still waiting for these statements, which is approx 9 weeks later from my first letter!
Could somebody advise me on my next steps please, i was unsure whether to write or phone lloyds bank to demand my statements within seven days or if i should just be patient and wait for them to be posted. Or should i report it to the financial ombudsman asap.
    Many thanks
    Paul

Right, you wrote the first letter, so now write the second. The template is in Martin's letter. Then take them to court. It's easy and thousands before you have done it.

I would call them and threaten other action if they are not supplied as its your information that they are holding.

I requested my statements from them and they were supplied withing the 40 days however my brother has waited about 80 days for his, so there is now sequence to it, he asked for his first.

The best thing to do is register for internet banking which I have done for the wife, this takes a week or so, then go online and you can print off the last 5 years statments.

    Good Luck
