    Hi I sent a 'letter before action' (stating I would settle for a slightly lower amount) to LLoyds tsb, to their recovery centre, Andover. I haven't had a reply, now what? Do I go to the court stage? I can't really afford to do that until the end of the month. Does it matter if I leave if for a bit? Is there a time limit between actions?

    Oh also. If it does get to the court stage. Can I recalculate the charges/interest, because the amount of interest (at 8%) will of changed from the date of my original letter to today (or to when I commence court action). Also they have charged me some more, so I will be adding them on.

    Do I need to send another letter to Lloyds saying that I am taking them to court and for how much??

    I sent letter to Lloyds TSB to claim £285 fees, which were mainly for going over my overdraft, or bounced payments. I had a letter back saying that They wont refund anything as they feel that the charges were fair and it was my fault to go over my agreed limit. So what do I do now? As Martin says it doesn’t cost them £35 if I go over my overdraft limit so what shall I write in response to their letter? How can I get my fees refunded??

    Hi,

    Ive recieved papers and forms from court in the post but before I fill them all in for mother iin law and it gets scary..should I write to lloyds again to tell them its their last chance to settle before I file a court case against them? Maybe say that I'll be happy to settle for original amount requsted,so no increase due to intrest going up? Also point out to them that as I have no court fees to pay (exempt) it doesn't matter to me if it goes to court,It will only be more cost to them.

    What do you think, please, I would really appreciate all views on this before I sit down with the court papers tonight.

    You could always try but you won't get a sensible answer. Most people would agree with me on this site and thats to straight to court. LTSB are different to the other banks who appear to be paying up without court action.

    Hi, i have been writing to my banks, have wrote to them asking for all my statements, which i was lucky as i did not have to pay for them, i checked how much i had took off me for being over drawn and interests charges, at the time it was over £680 so i sent my 2nd letter asking for them back, i recieved my notice letter saying they was looking into it, so i waited for their reply, a couple of weeks later i had got a letter saying they had closed my account, ok thats was far enough luck had it i had read about opening a back up account, a couple of weeks later i recieved a letter saying they was not paying the charges back, i then sent another letter telling them i was going to court.

    A cuople of more weeks later i got a letter from a debt colecting company saying they was cliaming the money back for TSB, i phoned them and explained that i was making a claim against them, they said they would put the account on hold why it was being looked at.

    Why this as all been going on i got a statement from Lloyds TSB and the charges have gone up now to £1,200, so i have been still getting charged for an account i do not have with them.

    I got a letter this week of Lloyds TSB telling me they were willing to offer me £630, i have wrote back telling them that i refuse this offer as they had been charging me since my account was closed still at the wrong charges and that it now stands at £1,200 and would like them to review my claim.

    I will keep this up-dated and be WARNED MAKE SURE YOU OPEN A BACK UP ACCOUNT TO BE ON THE SAFE SIDE!!!!!!!!!

    Hi all, just got reply from LTSB customer support recovery centre Andover, after sending the "letter 2" asking money back. It's for just over £400 for overdraft charge and unpaid standing order charge charged last 6 years.
    It says;
    "The office of fair trading has published new guidelines on credit card default charges. We're still talking it through with them, but the important point is that the guidelines are about 'default' charges that people pay when they break an agreement with us. This does not apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you haven't broken your agreement. They are our prices for the service we provide in these situations."

    Everybody received this? Am not if I should go to the next level with this reply... Can anybody comment?

    Just had a look on-line and they have acknowledged and defended my case in the sameday. Oh well didn't think im lucky enough to slip the net.

    Im just going to enjoy getting my money more now Lloyds. :)

    So now it upwards and onwards.

    has anyone heard of this then

    filed against lloyds and it ran out on 8th of may they didnt even aknowledge it so on the 9th i entered judgement against tsb then thought i would leave it a week to see what happens.

    i have today rang my court where it was issued and they said lloyds tsb did aknowledge on the 9th but because i entered judgement on 9th they threw it back at them saying they were too late,now isnt it a releif too know that they are on my side and not the big company.

    so i thought my next step would be now they know that judgement is against them i thought i would ring and try and get my money paid into my account asap so my question is has anyone got the phone number of where i should ring and who

    That is just their standard sod off letter, most of us got one of those, take no notice and carry on to the next stage.
