How long did it take you? I got a court date for two weeks today - Ive sent off copies of all statements, precidents etc and havent recieved anything from Lloyds, so as they havent sent me anything that they will use in court, what happens next?
I am hoping that as I havent heard from them, they may not intend to defend in court (I hope!)

SORRY IF IVE CONFUSED PEOPLE - can i make it clear the 2 success stories i posted where what i'd got from here and CAG (as i put in title line) just to give us all some motivation and hope
My claim is at judgement - i filed with MCOL on 5th April, deemed as served 10th April - they acknowledged on 20th April and on 9th of May they hadnt defended so i got a judgement issued - that has now been sent to there solicitors as that ive been deemed to have won by default and that they have to pay up - but we know lloyds and there games so im sure it wont be as simple as it sounds.
Never got to court stage so dont know the crack im sorry0 -

Hi there I'm new to this forum been reading it for a while though I am currently at the threatening court action stage of claiming £2852.58 worth of charges!!!!! I have given them seven days to reply then I will commence MCOL.
My questions are: are they closing many accounts?
How much success have people had?
Do they often take it all the way?
Could I end up paying all the court fees, including theirs?
Also they have nineteen days to respond after MCOL is that right?

I got a letter from their solicitors yesterday asking for all the information I had previously provided to LTSB. Contacted them and faxed it through. Phoned this morning to see if there had been any progress, guy at solicitors said they would have to request the file from LTSB to see if they were willing to make me an offer. I asked why they had requested information I had already provided and his answer was that LTSB don't pass this on to the solicitors!!! Makes you smile doesn't it :mad: :mad:

I have just received a reply from LTSB to my first letter which claimed 185.00 in total from 2 accounts. They are saying that the charges that I am claiming for were not default charges because they were for dealing with my request for going over my agreed overdraft limit, therefore they are not obliged to pay up. They are not default because i haven't broken an agreement. Is this right? I can't honestly say that I hadn't requested to go over overdraft limit, but on the statements they sent me the charges are put down as overdraft excess fee.
Am confused, and feeling intimidated

Lots of us have had the same letter - keep going, they are trying to put you off!!!

CAN HELP WITH MCOL
once you have issued it as an example i'll use date 1st of May - it wont be deemed served until 6th May - they then have 14 days from here to acknowledge the claim (if they dont then you can get judgement and win by default) if they do acknowledge then they have a further 14days to defend claim - which would make total of 33 days0 -

Thats great thanks for your help, does anyone know whether if I fail I will have to pay all the court fees theres as well cos I'm guessing that could get pretty steep

Hi all,
Been at this claiming thing with LTSB since November. Done all the letters as advised with no joy, did the moneyclaim online thing and yep you guessed it they filed a defence at the last minute so on arrival of my AQ filled it in and posted it back as advised on here and waited for their next move but on the 23rd April I got a letter from the court. It was a General form of Judgement or Order.It said before a proper officer sitting at the court an order had been made of its own initiative Without a hearing and it ordered that unless LTSB filed an AQ within 7 days their defence shall be struck out.
I was chuffed although not too sure what it meant but I phoned the court yesterday and they informed me that LTSB case has now been struck out and I have filed my judgement, I'm assuming this means I have won? So now I wait and see if my money appears.
Funny thing is all I claimed for originally was £400, If they had settled I would have taken £200 but now they owe me £617 and who only knows what else this has cost them?
I would just like to thank you all for the advice over the last 6 months and I'll let you know if any money comes my way.0
