    So (and forgive mr thick Geordie here!) my original claim was for £3,238.50 which is purely charges. When Lloyds don't respond and force me to claim through the courts, am I then allowed to claim that £3,228.50 PLUS the interest which would have gained over the years PLUS the cost of the court charges? Or do I still just have to file the claim for my original amount?

    Would be a nice bonus if I can whack on the interest on top! That would teach them to mess us around!

    yip Geordiebloke they then have to pay interest as well as court costs - make sure you put the interest amount on the forms - look on the moneyclaim thread on hear for wording to use so you can get interest.

    Timetable for ref

    Aug 06 £280 .charges applied to my account
    Sept 06 rang bank to complain and told ‘tough’

    Researched bank charges sites including no win no fee lawyers
    Nov 06 opened parachute account

    Nov 06 sent subject access request with £10 cheque recorded to local branch
    Dec 06 4 weeks later received charges lists from copy statement unit
    Dec 06 wrote in asking for charges to be repaid with 8%interest £4500 in total
    Dec 06 7 days later received sod off letter
    Dec 06 sent 7 day demand letter to customer service recovery Hampshire
    Jan 07 10 days later received a goodwill payment into account of £750
    Jan 07 next day received final response letter from Lloyds
    Jan 07 filed with MCOL after some jiggery-pokery with lines and word numbers
    Jan 07 acknowledgement of service received from Northampton court
    Feb 07 defence filed by SC&M, claim to be transferred to local court, AQ filled out and delivered with £100 cheque

    March 07 Today having still not heard anything since AQ submitted I contacted the court and was told that the judge has ordered a stay for 1 month without asking me or taking notice of my AQ
    March 07 applied for stay removal 4 days later stay removed and got a listing for June

    Today WE WON! letter from SC&M Lloyds will pay up in full including interest and costs and no conditions.

    settled: 2100.00

    Took a long time but won in the end. Initially requested statements in Nov 2006, eventually received a letter from their solicitors yesterday offering full amount!!!.
    Now just waiting on my husbands claim with Lloyds, filed at the same time so fingers crossed.

    Lloyds got till Saturday night to acknowledge my court claim on MCOL is it normal practice for Lloyds to wait this long?

    They know i sent the court papers as i have had a personal letter from them.

    They have untill Saturday night, they are leaving it late. They definately know i have sent the small claims courts in becuase i have the standard '' i see you have court proceedings against us'' letter.

    Sorry to be the bearer of bad news but I was told as there time is up on a Saturday they have until the Monday at midnight.

    Mine will be exactly one week later and my MCOL states the same as yours, and I have had the letter as you have.

    Thanks i thought it was to good to be true. I have never heard of Lloyds not defending let alone acknowledging a claim.

    BY WAY them success stories werent from me!!! i got them from posts to motivate everyone to prove people are getting money back.

    Just to let you know

    My friend got Judgement issued against Lloyds on the 9th as they never acknowedged her claim and I got judgement issued against lloyds on the same day, they acknowledeged mine but didnt put in a defence

    so we are both just waiting on hearing from there solicitors ref - payment (we hope)

    so they do let some slip through the net:D

    How long did it take you? I got a court date for two weeks today - Ive sent off copies of all statements, precidents etc and havent recieved anything from Lloyds, so as they havent sent me anything that they will use in court, what happens next?

    I am hoping that as I havent heard from them, they may not intend to defend in court (I hope!)

    Did you get this far?

    Also if you do manage to click on and get judgement - it is only seen as requested - the banks then have until 4pm that day to put in defence (so in theory they get 29 days) if they put in a defence before 4pm (when moneyclaim update there site) then it stands as defended NOT judgement.

    best bet if you manage to get judgement - is at 4.30pm on the day ring up moneyclaim to check banks havent sneeked in a last min defence

    its a mare - why give 28 days when its 29 - think its all down to how busy they are - sure someone on here said that the courts are 5 days behind (or at least some are) as someone went in to get judgement and were told they are 5 days behind so have to go through mail to see if defence has came in before issuing judgement

    lots of people are making lots of money with courts, solicitors etc

    Hi

    I sent letter number 1 to Lloyds TSB and got the response that my charges were justified and that they would not pay any money back. I then sent the second letter saying I would take them to court if they did not settle within 14 days.

    When the fourteen days were up and I had not had a reply, I sent the second letter again and made sure it was recorded and had to be signed for, and hey presto within 10 days I had a letter saying that the full amount which included interest would be in my bank as a "goodwill gesture" within 10 day. It was. They have to pay it back.
