    ltsb still haven't cashed the chq i sent when i rqst the past 6 yrs charges/statements. the 40 days is up tomoro so i'll be sending them the 7 day ltr. has anyone else had this where they haven't cashed the chq??

    Please can anyone who knows the situation please confirm this for me,

    my small claim was filed on the 19th of april lloyds have untill the 8th of May (today) to either aknowledge or defend the case if they dont and as of yet they havnt do i win by default and then put a judgement in for my money and then how long does it take can someone please come on hear and tell me as im getting very excited

    Hi There

    sounds like the situation im in too.
    i have issued the prilim letters and only had a response from one, stating that the bank would not be refunding me any amount.

    I origanally asked for statments along with a complaint about the way i was treated at my branch, regarding the re shuffling of a loan due to my curcumstanses changing.( as yet they have sent out a letter every 8 weeks to tel me that they have not looked at my complaint as they are dealing with a high number of complaints at this time)

    They havnt even informed me that if i pay £10 i can get all my statements for the last six years.

    Luckely my wife is very organised and kept them all anyway so i followed the advise and used the letters from this site to start my claim.

    Since lodging my first complaint i had to ask for an increase to my overdraft facility by £250 from £100 and was point blank refused, so i think i have been black listed.

    I have no problem in persueing this all the way to court now as i feel very let down by the bank. and have no intention in staying with them.

    The claim is for charges amounts to £2700,
    I am in scotland and see that small claims is only up to £750, How should i persue this.
    Should i speak to a lawyer?

    in the mean time, the bank are taking so far 4 months to tell me that they havnt even looked at my complaint regarding my loan which is having a negitave impact on my accounts etc while i wait for decisions.

    do i have the right to withdraw my permission for them to take money from my account for the loan repayments until i have a recieved a descision on the matter?

    can anyone give some advise on this?

    Oh yes and the bank is the clydesdale

    Don't worry they did not get round to cashing my cheque for a few months, I think they had entered a defence by then

    no defence entered as yet - dont think my heart can handle anymore - have until midnight to do so

    spoke to my friend who works for a solicitors and she said when they defend they have to do so by 4pm as thats when courts close, but she wasnt sure on moneyclaim - think its until 12 midnight as previous people have said as when you log on obviously theres a bit for the defendant to click on.

    its doing my ticker no good - just want to know!!!

    hi all i send my cheque to the tsb for my statements in april cashed it a few days later then in may took another 10 out for my statements again apparently u dont have to send a cheque for the 10 quid cos they say it comes of ur account in any case so now i have to chase up the 10 quid for charging me twice plus going to take up to court now cos i havent heard owt and the 14 days is up cheers john

    Im still no further with MIL's claim for £1700..we should have got cracked on with taking the bast@rds to court by now. I think someone has asked this before but I don't think they were answered but..Is it best to do it all through mcol or local court? Ive looked it up and our local court is really local lol..just 2 miles away! So would this be the best option? Also,MIL is exempt from fees..do I need to call into the court for fee exemption form or something?

    if you are exemption of fees i would go to your local court !
    the form is a EX160 you can down load this form from the web site of local courts.x Good luck :confused::confused:

    Don't want to put a dampner on things but a defence was entered on our claim at around 10.30pm.:mad:
    We are now waiting a court date as it has been referred to the local court.
    LLoyds are not the only ones waiting to the last minute - HSBC entered their defence at 11.45pm.:confused:
    I think they issue them from a central computer and deliberately wait until to the last minute to press enter.:rolleyes:
    Can't wait to get my money back and park outside the branch in my lovely new car that Im going to buy with the money!:p

    I really hope you are the exception the rule and you can claim by default.

    We will be the same on Friday when Marbles' 28 days are up.
