    Hi all,

    I just wanted some advice, if possible. I know everyone is in a similar situation and quite busy with their own claims. I got my statements with 6 months missing information. I wrote another letter to Lloyds and at the weekend received statements again, this time with 11 months missing. I have statements now up to September 2001 (I asked for March 2001 onwards). Should I write to Lloyds again asking, again, for the missing statements or should I write to the information commissioner now that they haven't provided what I asked for in the time scale they give?
    I'm very tempted to go to my local branch telling them I want the information as I have paid for it - but could easily get turned away being told that they can't access statements from 6 years ago.

    I sent my letter requesting the charges back for x2 accounts on thursday 1st class and recorded delivery to the Gresham Street address. I've tried to track it online via royal mails website and they have no information available for it, I hope they've signed for it :(:(

    I have done my first two letters to lloyds and now at the stage to take to court, not sure whether to hold on and see if i get an offer or go ahead and if i do go through the courts can i claim an additional 400 odd in charges that have been added to my account since i started the whole claim procedure, any advice welcome. thanks

    spoke to moneyclaim and she said in thoery they have until midnight although nothing normally happens after working hours

    wouldnt hold your breath waiting on an offer from lloyds - very few people have had offers without court stage

    I sent my first letter recorded and tracked this, however my second letter to them I again sent recorded and this never arrived, the post office adviced me that a letter sent recorded is not guarenteed to get there you need to send it guarenteed next day delivery (£4.50 each). I was worried that as I could not track the letter then I could not prove in court that it had been delivered which is why I resent it guarenteed next day.

  • I am hoping someone out there can help me. I have been following Martin Lewis's forum on how to reclaim unfair bank charges. I have followed it letter by letter. I got sick of them keep responding to my letters with their own, explaining how they are justified in charging large amount of money.

    I then decided to get the Financial Ombudsman involved how sent them my complaint. I thought this might carry a little more weight, but today I received a letter back......

    ....Dear Mr *****

    Thank you for getting in touch with us again. I am sorry you are still unhappy about your account charges.

    We've already explained that we believe it is fair to charge you for extra services you've requested, as long as you know about the charges in advance. When you didn't have enough in your account to cover a payment, we had to agree to make it by setting up or increasing your overdraft, or tell you we couldn't agree it. We feel it's only fair to charge for our service in considering and implementing this.

    We've made it easy to keep a running check on how much is in your account. You can get an up-to-date balance at any of our cash machines, over the phone, on line and by weekly text to your mobile.

    If you know a payment is going to take you over your agreed limit, you're welcome to see if there's anything we can do.

    Generally we don't agree to adjust any of these charges, but I can tell you that on this occasion we are prepared to repay you £460 in full and final settlement of your complaint.

    We will credit this amount to your account within 10 working days. We will also cancel any charges that we may have told you about but have not yet been taken from your account. We will not refund any overdraft interest, standard account or service charges.

    I hope you now feel that I've been able to answer all the points you raised with us. Please treat this letter as our final response. This means that if you're still unhappy, you can ask the Financial Ombudsman Service to investigate your complaint, so long as you do so within six months of the date of this letter.

    I am enclosing a booklet about the Financial Ombudsman Service which includes their address and telephone number.

    I am at a loss as what to do now..??? Do I go through the Financial Ombudsman and see if they can take it further? Or do I go back to the 'Martin Lewis's website and take them to court? and if I do then how do I do it? Are they just testing me... think that I won't go through with it?

    Please.... I hope someone can help with this...

    Standard letter from Lloyds, send them a letter back saying thank you but no thanks and you will be proceeding to court for the remainder of your claim.

    tell ya its stressing me out - think i'd almost rather have the word defend there as my heart can hardly take anymore!!!

    we'll see - still expecting the word "defence" appearing - wont hold my breath - you never know maybe i'll be lucky?? will make a change
