    Hi
if i get no joy phoning tomorrow ,then i'll start the court proceedings.
Would it be better to file with my local court or start from MCOL?
I'm already going to court with Abbey , the are defending, so i've been trying to get the court bundle ready just in case i actually need to go to court!!
Now that has my leg turning to jelly,,,, not looking forward to it..has anybody actually been to court???
    any advice welcomed!!

I think the important thing is that the banks have not shown up for court! Lloyds always seem to drag it out as long as possible. ( probably so that people will back down ) but it seems that they and all the other banks settle before court.
I wonder how many people have decided not to take it any further once the first 2 letters receive a " No we are not refunding your charges" letter.

Im sure they will pay out before it gets that far.

    Good Luck

It would be better to print out all the pages with the charges on. Thats what I did!
Did you send your letter "signed for" ? You should make sure they have received it.

Or note down all the charges/dates/amounts put them in the interest calculator and send that with with the LBA letter, while you are waiting for a reply you will probably get your statements through the mail.

    Hope this helps

Hi, not sure when your time was up to start your MCOL, but assume its only just up? If so, then, it could pay to wait. MY OH managed to get through on the number on the letter (after a LOT of trying !!)and they told him they would reply to ALL letters , just not necessarily in time frame cos of sheer volume of letters they are getting. He asked where they were up to and they were only about a week and a half behind the date he sent his letter, so he hung on and got the £750 offer letter that many are getting, abt a week later. So if you are claiming £750 or less , you may be as well to hang on a couple of weeks, otherwise you may as well start claim - likely you will still get the £750 letter anyway eventually I think!

Thank you for your letter dated 30th march i am sorry that you,ve not been happy with our response so far.
i am unable to add to our last letter because our points were made.
We see from our records that you have already issued a court claim for payment of theses fees and that our solicitors are dealing with this. Apart from explaining our position theres nothing more i can do to help you at this stage.
Thank you once again for taking the time to raise your concerns with us.
this is dated the 3rd of May the date they filed a defence .
So here we go the fun begins now !!!

Best of luck in getting thru on thsose numbers supplied. I also thought I would call them to see if they were going to pay out but after a week of getting a constant engaged tone I issued ct Proc' and they have until 13th may to defend the claim.
Fingers crossed they forget me and I can request judgment, saying that it appears that Lloyds are the hardest to deal with so far.
    Just claim!!!!!!
