This exceptional arrogance by the banks drives me nuts!!!
Unless you have agreed this is a full and final settlement, I would reply with a strongly worded letter. Let them know this is accepted only as part payment and in no way is it a full and final settlement. You will continue with a claim for the remainder.
As soon as the 14 days is up from your Letter Before Action, start your court claim.0 -

The story:
1) Worked charges dating back 5yrs via online statements.
2) Sent letter asking for a full refund of charges giving 14days to reply on the 05/02/07. Received standard fob off letter on the 09/02/07.
3) Sent LBA on the 21/02/07 to no avail. However bizzarely enough I received a letter from Andover yesterday saying they still stand firm and can't do anything. Funny that, 9 weeks later I receive a reply!!
4) Filed through MCOL on the 21/03/07 which was deemed served on the 26/03/07. Lloyds acknowledge on the 03/04/07, then on the 09/04/07 they enetered a defence. Grrrr!!
5) I received the notice of transfer through to my local court, without an allocation questionaire, apparently these have stopped now due to the sheer volume of claims ongoing.
6) Had another letter about a week later to say my court date will be on the 04/06/07 saying the judge is allowing only 5 mins to hear the case and to ensure I send my court bundle to the court & Lloyds 14 days before the date of hearing.
7) I was planing to start my bundle this weekend when a letter arrived in the post this morning from SECHIARI,CLARK & MITCHELL- SOLICITORS.
The letter goes on to read:
We refer to the above matter and confirm that our client will be settling your claim within 5 working days by depositing the sum of £1836.67 (inclusive of interest and fees), into your Bank Account.
You are advised at this stage that by our client meeting your claim on this occasion, this is not treated in any way as an admission of liability. This is merely an attempt to resolve the matter amicably between the parties concerned.
We therefore trust you shall write to ****** County Court to confirm that the claim has been settled once the funds have been received and provide this office with a copy of the letter for our clients records.
What a result, I thought this would go all the way to court and half expected them not to turn up.

Missc and all other Lloyds claimants, keep going there is hope. Just stay patient and as the saying goes "a watched pot never boils!!"

Ok.. Here's a puzzler
I had gotten to the second stage of claiming £270 from my joint acc with OH and first stage claiming £480 from my individual account, received the standard letters, but thought I was going to have to pursue etc.
Anyway, last week £410 was deposited in the joint account as a goodwill refund. I was not informed that they were refunding any money to me/us at all, and obviously the amount refunded is a fair bit extra than I was claiming for that account. Not sure how to proceed as phone bank wont be able to tell me anything about the claims. Not complaining though!!!0 -
i am in the process of claiming back from lloyds and reading through it would appear they are the hardest bank to claim from, i am at stage to use money claim, hopefully it will then go through quite quckly, but they do seem to push you into a corner0

hiya i got the same thing my claim was for £1250 so i wrote to say i accept the £750 as partical payment and i am claiming for the rest they put the £750 in my bank and i've spent it so i don't think they take it back off you and that was quite a while back.
Thanks for that ( thanks button not working for me at the moment!!), can I just check 1 more thing ( sorry!!), when he does the claim will he work out the total + int - 750 and enter that as his claim amount, or do the total claim amount , and they will already know they have paid 750 so will deduct that when (hopefully!) they pay out? Sorry if this will be obvious when he actually does it - this is his 1st one!

i done the particulars of claim with the full amount+interest then at the bottom put 'as the defendant has already made partical payment of £750 i would ask the court to rule in my favor for the outstanding amount of £xxxx '

hi all just need sum advice plzzzzz going to start court proceedings against llods on tuesday as they havent written back to me and there time is up on mon but seen as its a bank holiday going to wait till tues but im confused in april got charged £424 charges and may £251 but i didnt put these in me claim because i had wrote to lloyds b4 then phoned up tsb asked as a goodwill jesture would she take of the £251 for mays charges and she said no so when i start filling in the court thing do i add these on then , also i have a loan and phoned the loan department and changed the date i was going to pay cos now going to monthly pay the lady changed this for me but when i looked into my internet banking she hadnt took the payment out so i went into arrears now checking my statement for charges next month they have charged me £ 25 for not paying my loan on time but i cant understand how this can go into me charges when i know me loan is from the same company but it was from direct loans part of tsb but in a peterlee so how can they add charges to me bank account any ideas0

yes you just add them on to your original list of charges when you fill out your N1 form.

am just about to go to MCOL for Lloyds, but thaught i might phone them and see if they will offer me anything before i take them to court. What does anybody think, good idea?? maybe not?? If a good one who do i phone, and the number.
