We have received an offer from LLoydsTSB for £750 as a gesture to our claim for £4304 between two separate accounts. This money has already been put into one of my accounts.
I do not believe this is a fair settlement and wish to go on with my claim.

I was about to lodge this claim with MCOL. How do i go about it now? Do i have to write to them rejecting their offer? can i accept as a partial settlement? can i spend the £750?

If i need to write to them is there a template letter to help out?

I have one last question to ask please, i have written to LloydsTSB separately regarding my two claims, claim 1 =£1910, claim 2 +£2394. When lodging my claim with MCOL, can i lump the two claims onto one claim? obviously this will save £120.

I would be grateful for any help, sorry about al the questions.

    Regards,
    Paul

    hiya paul,
they done the same to me and i have spent it,i still claiming for the rest, first you need to send them a letter to say you only accept as part payment , this is what i wrote:
    dear sir/madam,
i am writing in response to your letter dated xx/xx/xx offering a goodwill gesture payment of £750,
i would like to inform you that i will only accept this amount without prejudice as partical paymentof the amount i originaly requested of £xxxx in my letter to you dated xx/xx/xx and i will commence court proceeding for the outstanding amount of £xxxx plus costs if i do not receive a full response within 14 days.
    yours faithful
    xxxxxxxxxx

    hpoe this helps you !!!!!
as for MCOL just stick it at the bottom of the particulars of claim that you have had a partical payment of £750 and then put the total outstanding amount

good luck mate!!! they have just defended my claim the bas***ds:mad:
  • They are just trying to get away with it, press on!

you can send it to either or - preferably your branch as thats who have taken the money - you will find it then gets sent to London anyway (but doesnt add extra time on)

the £750 is the standard lloyds thing (its now sooooo boring they should bring out a new tactic lol) - however i feel left out as i havent receievd that!!

you write back to them saying you accept the £750 as part (parcial??) payment without predjudice but will persuing your claim with the courts for the rest of the money.

not sure if you can bulk claim together - cant see why not if both are in your name - i would check it out on here (possibly the MCOL thread) would assume as long as you state BOTH account numbers it should be fine.

Received a letter from Lloyds TSB today offering £750 as full and final settlement. This was dated 25 April. My MCOL was issued on 19 April and this is the first I have heard from the bank since then. The £750 is supposed to be paid into my account in 10 working days (which I calculate to be Wednesday next week). It's not there yet, anyway.

But my claim was for £500 including interest and MCOL fee. Obviously I want to accept the £750 but should I cancel the MCOL now (even though I don't have the money from Lloyds yet - just a letter to say I will be getting £750) or do I wait until I actually see the money in the account.

I am concerned that the letter from Llloyds offering £750 has crossed with the MCOL and they are thinking that I have rejected the £750.

How long does it take for the £750 to come into the account for those that have been offered this standard payment?

dont cancel anything until the £750 is in your account. once its in then cancel the moneyclaim

Do they pay the £750 exactly on the last day of the 'within 10 working days' that they put in the letter?

Obviously it's in my interests to get the £750 from them as that is more than I claimed in the first place.

I don't want my current MCOL case to jeopardise the £750 payment.
