Hi, I am trying to reclaim charges from Lloyds TSB, amounting to £2500 including interest. They sent me my list of charges, and I sent the template letter requesting a refund. They have now sent me a refusal letter which claims that the charges are not 'default' charges, but 'service' charges.....
'The Office of Fair Trading has published new guidelines on credit card default charges. We're still talking it through with them but the important point is that the guidelines are about 'default' charges that people pay when they break an agreement with us. This does not apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you havent broken your agreement. They are our prices for the service we provide in these situations'.
All of Martin's template letters refer to claiming back default charges, but what do I do if the band denies that that are default charges, and claims they are charges for a 'service' I requested? ie the service of sending me a letter which I clearly did not request.

Standard letter from Lloyds, next they will offer you a "goodwill gesture" and put it into your bank. Just send off the next letter.0

OK, I've totalled the charges up using the interest calculator and it has come to £4008.07. Shall i head straight for the second letter and miss the initial one and just chop off the top section of it? Do you think i can get back the whole amount as it is quite a lot... will it be a more tricky process? Also what address shall i use for the second letter as there seems to be sooo many different ones flying around?

Your could go straight to letter two - lets face it they hardly ever reply to letter 1 anyway and so you could always say you sent it and had no reply so then went to letter two.
You'll defo have to go through moneyclaim anyway - i'd all but bet my life on it - welcome to the lloyds hating club cause belive me by end of it you'll be hating them with a vengance.
they NEVER pay up on claims over a grand with out court - or at least ive never read of one in the last 4/5 months and folk on here will tell you im on this page all the time.!!
you too will become obsessed with find out there latest tactic etc

Hi, just logged into the moneyclaim website for my partners claim, he is claiming 4600 pounds from lloyds, they have now put a defence in and moneyclaim say that they can do no more and we will hear from the courts shortly, anybody else experienced this and how long roughly will it be before court and do lloyds tend to settle before court or what? any help would be greatly appreciated.

Now, as im disappointed at their lack of reimbursing me, i'm gonna complete my MCOL claim which i set up weeks ago. I'm claiming for 2 accounts and sent my letters to Lloyds in two seperate packs, one for each account. My complaint reference number is the same for both accounts, so what do i put in the amount i'm claiming? Its £2600 for both accounts, also do i include the £200 they've charged to my account this month when i enter the final figure on MCOL or do Lloyds automatically pay that too?

Also, what do i put in the particulars box in MCOL? Is there not a templated guide for people who arent very literate? I think it puts people off filling it in and claiming. Also do i include the charges recently applied to my account too or will Lloyds reimburse those too? Total im claiming for is £2600 but there's another £195 of charges on my account since the last letter. Do i include that too?
letter is the "new" standard respone (my hubby got same one for a £90 claim other day)
You can claim for both accounts on one (im almost sure) however make sure you put on both account numbers otherwise they query it and yes include latest charges.
go to the MCOL thread on here it has template of what to put in (you just amend to your details) however it takes for ever as your only allowed so many letters and lines etc so you have to spend for ever taking out spaces and randon full stops etc to make it all fit - too me a frustrating hour and a half!!0 -

iM NOT SURE - but theres loads of folk on this thread at same stage. Sure Jen1972 knows the crack - just know if you think its been long winded so far your in for a further long waiting game. some people are waiting upto 4/5 months for a court date!!!
Anyway just picking your brain - what date did lloyds acknowledge on your moneyclaim? mine was acknowledged on 20th of april - expecting defence v soon

got a letter today stating the charges that I wanted refunding were not charges but for a service they had provided any advice0

Hi peeps. ive recently sent lloyds tsb the letter stating how much the have charged me in charges over the past 6 yrs and that i want to reclaim them or take them to court. This was about 6 weeks ago and i have not had a reply!

go to home page - then onto the reclaiming bank charges in centre of page - gives you step by step instructions. ALWAYS keep to your time table - never let banks dictate - if you said in first letter you gave them 14 days - then after 14 days whether you have had a reply of not you go onto stage 2 so on an so forth - its a long winded process and if you wait around for banks to reply you'll be in for a very long unsucessful wait0
