    I went over to the court on friday and they said all YB cases have been moved to the chancery section where the judge looks at all cases regarding the bank charges and then it goes straight to a hearing (if it gets that far) all AQ's are dispensed with


    Rang court today, they said the next hearing date is 28 june, and all cases that have been submitted to the judge within the last 4 weeks will attend this hearing.

    i was lucky my mums loaned me it and i just have to pay it back once money comes through otherwise i would have been in your situ - it is a pain

    The charge should be left until a guilty party is established and then they should be made to pay the fee.

    I had to lend this from family as I was in the same situation and promised to pay them back.

    Hi,

    Does my MIL have to pay if she is on disibility benefits? Also,as she is disabled,will she have to attend court if it goes that far?

    Transferred to a local court now for hearing on the 19th june but i have to pay another 100 quid out (ggggrrrrrrrr!!!!!!), nightmare, no offer of goodwill yet either
    i know i should pay it but i would have to borrow it and i dont want to get into debt.......help please

    juat a quick update ..Lloyds have now filed a defence the !!!!!!...that was yesterday i checked MCOL today so now just a waiting game to get my money back i hope ....
    hows things going for you ??there seems to be a lot in the same situation at the same stage at the moe !!! I spoke to a lady at MCOL today she said how anoyed she is getting that some banks are taking it to the bitter end and still have to pay out in the end ....she also said they usually ring daily to monitior the claims made and to check any progress , i said i was shocked !! i didnt think they cared but she said ho yes they are !!!so we shall see
  • I am at the about to file a MCOL stage for just £100 not including interest, but sent a final last ditch attempt letter a few weeks ago to try and avoid it. I work for the Credit Management department of a utility company, so tried a different tact. As I am awaiting a court date with HSBC for £700, and I paid for it with my Lloyds card, I highlighted this to show that I wasn't scared to do it.

    My letter included the following:

    "I refer back to my previous letters where I have stated that your charges are unfair and not proportionate to your costs. Regardless of whether you call them “default” charges or not the fact still remains that these charges were not a true reflection of the costs to yourselves to manage my account. Please send me the detail of the steps that your company took on each occasion to contact me and agree to my request to go over my overdraft limit (which I maintain was never made), and the cost to your business in phone calls, letters and FTE.
    You can see from my current account that I have recently taken another bank to court via Money Claim Online, so I am comfortable taking the action needed to pursue this claim via the county court. I am also fully aware of operational costs in both the UK and India as I have managed operational credit management teams both here and overseas (again partly demonstrable by looking at my banking history over the past few years)."

    I appreciate most people here can't talk about awareness of the operational costs in quite the same way, but anyone can request the breakdown of the costs and contacts made. I also think it's useful to highlight if you can that you have already taken another bank to court to prove that you're not bluffing.

    Anyway - they wrote back today offering £77 as a full and final which will supposedly be credited to my account in the next 10 days.

    I have just received my response from lloyds after sending them the letter threating to take them to court and giving them 14days to respond.

    The response read that they were unhappy that I was not satisfied with the service that they have provided and the responses that they have given and have put an account manager in charge of looking at my complaint and will respond in 28days.

    Has anyone else had a similar response from Lloyds, if so did you wait the 28days or go straight to the claims process (which is what I'm thinking I should do)?

    any advice would be welcome.

    This is a delaying tactic so yes stick to your timescale. They sent me a similar letter following it up with a further one after 28 days saying that despite their best endeavours they were not able to complete their investigations within the timescale. They said that they would update me within a further 28 days. Absolute nonsense. During this time I proceeded with my claim and to cut a long story short, eventually received the £1472 asked for

    me also in the same position they also defended my claim on the 1st so keep me up to date i am so so scared but i will take it to the bitter end !!
