    I've just recieved the exact same letter. I am owed £3,500 in charges by them and am absolutely livid.

    Should I now start court proceedings or will that just rule against me also?

    We've never had a family holiday since 1988 so was banking on getting these charges back so I could at last be able to afford a holiday.

    Lloyds TSB... Thieving Scum Bags.

    Once you have given them the 14 days to pay back what you are owed you can then take them to court but make sure you follow the standard letters and allow them the 14 days. They owe me and I have filed MCOL against them last weekend, if you read this thread there is some good advise on here.

    Use the standard letters on the home page but go for it.

    this is a standard reply , take no notice and go on to next stage of 2nd letter using your timescale, i had same letter back in jan and am still fighting. LTSB are sods they have about 1/2 dozen different letters and they send them out randomly but all mean the same...these are the bank that doesn't like to say yes and should be done by trading standards

    bascially went on and on about "do you know you can reclaim bank charges" - i said "yes im already doing it"
    he replied "do you know if you do it yourself they hold back 25% of the fee"
    I said "no they dont if someone like you does it for me YOU hold back 25% of the fee"
    he was very rude and said "NO I DONT we charge a one off fee of £39 pound"

    I said you dont know what your talking about - they do NOT hold back 25% of the fee its people like you who do"
    he then swore at me and hung up

    silly fool didnt withhold his number so rang back - got his voice mail - advised him never to call me again as his facts were wrong and he was a !!!! :rotfl:

    just incase people get a random call - number was 07715993824

    obviously someone trying to pull fast ones!!

    i didn't use the template letters from this site cause i started claim before i found it so made my own up saying "no i'm not happy and i will take it further" basically. however with lloyds it would matter what you say they don't wanna pay. the template link in on main bank charges thread for all 3 letter sorry i can't direct you but i have limited computer ability. Even with my own letters i'm going through the motions so its up to you. Also you can't add interest til court stage

    Hi RodBell

    Just had to reply to your message. We also bank with Lloydstsb Andover branch and received a near identical letter from them when we started to claim.

    We sent the first letter and received a similar letter to yours back, but went straight ahead and sent the second letter.

    We then received another letter from them that was very similar to the first letter but basically saying that they were sorry to hear that we were not happy with the charges but tough!! So I went ahead and filed a court claim online last week.

    This morning, I have had a letter through from them offering payment of 622.00 pounds in final payment!!!!! 225 pounds less than the full amount we were claiming plus it cost 80 in court fees, but they have made an offer:T .

    Just stick with it and dont let their standard letter put you off!!

    Seems my sister got lucky, she claimed on behalf of her husband for a small amount I think around £150 and said lloyds staff gave her advice along the way and she got it back within 2 weeks. I think she must be one of a very lucky few.

    My other sister's boyfriend claimed with hsbc and also had it easy (much larger amount).

    I just got exact same letter today too. I know what you mean about not even having read the original complaint. They must be having some letters about using personal information so they just churned out a standard letter to cover the lot.

    When I spoke to my account manager before I even wrote the letter he said that the staff at working at the bank get charged more then a normal customer for going over the limit and get a written warning and can even be sacked if they do it more than twice! Sounds like a great company to work for...

    I am moving to the next stage now.

    Geordiebloke - fellow geordie lass here - welcome to the world of lloyds tsb - they are a mare and we are all in the same boat - courts it will have to be they wont pay up pre that.

    sooner rather than later i'd say

    sometimes for small amounts you get lucky and they pay back without hassle (not all the time though)

    Other banks seem to be a lot easier to deal with - i know halifax seem to settle easily!! typical of our luck banking with lloyds
