Hi Miss C AND co...
juat a quick update ..Lloyds have now filed a defence the !!!!!!...that was yesterday i checked MCOL today so now just a waiting game to get my money back i hope ....
hows things going for you ??there seems to be a lot in the same situation at the same stage at the moe !!! I spoke to a lady at MCOL today she said how anoyed she is getting that some banks are taking it to the bitter end and still have to pay out in the end ....she also said they usually ring daily to monitior the claims made and to check any progress , i said i was shocked !! i didnt think they cared but she said ho yes they are !!!so we shall see
The point that the lady from MCOL has made is crazy, surely this must be a misuse of the courts system and something should be done. How are these people getting away with this, if this was you or me then it wouldn't happen.0 -

you are mist certainly in for a battle - yes it does seem lloyds sucesses are much less than others, probably only cause once you eventually get the money back off them your too exhausted to type in your sucess :rotfl:
look on CAG site and go to the Lloyds forum on there and read the "success stories" - there is loads on there and easier to read as they have a seperate thread for it
lloyds let just about every one get to the court stage and beyond
clock the lloyds thread on here - its hilarious0 -

Just checked on line and no defence filed as yet (acknowledged on 20th) when was yours acknowledged?
Its good where all in the same situ makes things easier for us
Its probably just Lloyds - i reackon we should bung MOCL 10% of our claim per person to fail to advise LLoyds about all our claims LOL
Cant belive banks go to bitter end and still have to pay man its soooooo annoying   :mad:0 -
With the promotion of claiming back owed charges here (mainly) and Martins TV appearances my wife a few weeks back popped into Lloyds TSB and they offered a service where the go back through your statments and find all charges for a £10 fee.
We did, we picked out those charges we can claim for unpaid DD's, Cheques, Overdraft charges (specific ones), and and the end of picking them from the charges it came to just over £1000 :j
Today we recieved this letter.
Could any one advise us what to do...It reads like they have not seen our statements we sent back, and they mention we can pay £10 for the statements (which we have)
Thank you26th April 2007
Dear Mr & Mrs
Thank you for getting in touch with us. I am sorry you are unhappy about your account charges.
Like any business, we do make a charge for some of our extra services. When customers don’t have enough in their accounts to cover a payment, this always means extra work – and it has to happen very quickly. We have to agree to make the payment by setting up or increasing an overdraft, or tell customers we can’t agree it. We feel it’s fair to charge for this service.
Of course it’s only fair too, that we’re completely open about any charged-for services before you might need them. That’s why we take care to give every new customer the latest guide to our charges. You can also get up-to-date details about fees and borrowing rates at all our branches, through our help lines and on our website.
Just as importantly, we do everything we can to help our customers avoid these charges. You can get an up-to-date balance at any of our cash machines, over the phone, on line and by weekly text to your mobile.
If you know a payment is going to take you over your agreed limit, you’re welcome to see if there’s anything we can do.
The Office of Fair Trading has published new guidelines on credit card default charges. We’re still taking it through with them, but the important is that the guidelines are about ‘default’ charges that people pay when they break an agreement with us. This doesn’t apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you haven’t broken your agreement. They are our prices for the service we provide in these situations.
I understand that you may also have some concerns about us sharing information about your relationship with us with the credit reference agencies we use. I’d like to reassure you that this does not apply to bank charges; we only share what is known as white data, which is information about payments to your credit card, loan or mortgage accounts.
I do hope you can see that we make our charging system as fair as possible – and why I cannot agree to cancel your charges.
If you asked for a copy of statements and paid the fee, we’ll send them to you within the 40 day limit set by the Data Protection Act.
If you have not yet sent the £10 fee you will need to send it to us at the address below. The 40 day limit starts when we receive your payment. Please quote the reference number shown above when you send your cheque to us.
I hope this fully answers your points you raised with us. Please let me know if there is anything else I can do to help. If we cannot come to an agreement, I will provide you with details of the Financial Ombudsman Service so they can consider your complaint independently.
If you are happy with the way I have dealt with your complaint, there is no need for you to reply to my letter. If I have not heard from you by the 21 Jun 2007 I will close my file, though of course I will re-open it should you come back at any point afterwards.
Yours sincerely,
Debbie Gilbert

i no its bad aint it !! She also said most banks are also paying out to legal rep adding to more costs to banks !!!they prob just hope we will get so so scared and back out !!! well i am scared but I WILL NOT back down now !!
Good luck
thing is for every 10 of us that proceed and dont get scared i bet theres probably double that who back out and dont bother (cause of either the court costs or fact they dont have pc's so cant get online to this fab web page so therefore dont know the moves that the banks pull. So where its costing them in legal feels and paying interest they will be saving probably 2/3 times more in folk who get too scared
just my theory0 -
I've just recieved the exact same letter. I am owed £3,500 in charges by them and am absolutely livid.
Should I now start court proceedings or will that just rule against me also?
We've never had a family holiday since 1988 so was banking on getting these charges back so I could at last be able to afford a holiday.

I'm not scared either and I will take them all the way. I'm only doing this for one account at the moment if they had payed up quickly I would have signed an agreement not to do this on my 2 credit cards or my 2 other accounts but now I'm going to do this on all of them. So its there loss....
Good Luck...0 -
