I have gone though all the process, lloyds bank have put a settlement in my account that i didnt agree to, I wrote a letter to say take it back but they havent and now they are startng a defence, im getting worrid dont know what to do, it has been refferd to court and i dont want to lose what ive been given can anyone help what happens next??!!!

Just write to them and say that you accept the money on the understanding that it comes without conditions and is a part payment towards your main claim.
Hamsters have no tact and diplomacy, nor do they want any.

dont be just read around these sites it aint unusual for lloyds to go this far - you may even have to go into court but dont fret they dont turn up.

go onto https://www.consumeractiongroup.co.uk then go to the lloyds thread on there and theres loads of people who have actually been to court so you can get help and advice off them

found the below post on another thread ref someone who was also a bit scared about going to court

Not necessarily. Not all banks defend and none of them turn up at court so dont worry

If you do have to go to court, again dont worry. Take a look at one womans experience of being inside the courtroom. Its reassuring and inspiring. Top thanks to OP showmethemoney! for her post.

  • I GOT THE SAME LETTER TODAY! im so angry, im 'only' after £700 from them and im not going to lie when i got this letter i though !!!!! thats it im not getting a bean from them!.
its taken them nearly 30 days to get this reply, from start to finish, whats the next stage? if i send them the template letter on this site saying i want my money within the next 14 day will i really get a reply or will i get another one of these letters? i feel got fobbed me off with a letter saying they are 'allowed' to take 8 weeks and now this is the next letter i got.
    any advice would be great!

im also taking halifax to court for £150 and they sent me a letter saying i will hear from them by the 21st of may- more than lloyds did.

will they really respond within 14 days if i say i want that or will it get lost in there files?

at the end of this letter it says if they dont hear from me by the 19/06/07 they will close the file thinking im fine with it!

    HELP!

read through this whole thread on lloyds TSB and come to your own conclusion about whether there gonna pay up without court action - there a nightmare. you need to send you "LBA" letter threatening court if you havent already done so , i would give them 7 days nOT 14 - you can dictate the timescale plus you have already given them 14 and gotten no where - you WILL have to go down the court route i can guarantee that much

there a bunch of TW*Ts

surprised about Halifax there normally quite good - i'd ring them up for sake of £150 see if you can get away without the court - give them the option - they have a really high rate of paying back without having to go to court (ALTHOUGH THESE DAYS the claims are coming in thick and fast so may have changed a bit)

Hi there, eventually i got through the copy of the statements listing all the charges since 2001. There are a few variations.... can anyone advise me what ones to claim back out of the following....O/Draft interest [NO], O/Draft usage fee [NO], Account charge [NO], upaid D/D [YES], unpaid S/O [YES], unpaid cheque [YES], and O/D excess fee? [YES]

What should i do next total the relevent charges up and then send a letter asking for them back? A lot of people have said go straight to the second letter template and skip the first?

    Thanks v. much

Check my YES's and NO's ^^ (and my sig)

I made a claim online to reclaim my bank charges of £2200.00 after the bank had not responded. After 14 days still no response so I enter judgment by default, and a then issued a warrant of execution which were both accepted and confirmed to me by the court in writing. Today I have received a letter from the bank saying that they are sorry I am still unhappy and agree to deposit £750.00 into my bank account within 10 days. I would like advice on what I should do now. Can I accept the offer and continue to claim the rest or should I write to the bank requesting for the full amount to be paid in to my account as my claim was won on judgment by default?????? or does the warrant of execution override both options and I just hang on in there??? Confused...
I plan to speak to the bailiff tomorrow who is dealing with my case.

Any advice would by greatly appreciated.
