Hi, had great advice from liddled earlier, so have put together this letter to send to lloyds tsb, does it make sense? have i missed anything crucial out of it?
"Thank you for your letter dated April 2007 (copy attached) and the cheque that you enclosed for £293.10; paid to me for the interest that I had paid during an interest-free zone on my account with you. Please note that I only accept this cheque as part-payment, and without prejudice against any claim that I may make, against Lloyds TSB Bank plc, in the future.
Bearing this in mind, I therefore reiterate the first letter that I sent to you on 5 April 2007 (copy attached) asking for a fully comprehensive list of all the default charges for direct debit, unauthorised overdrafts and standing orders that I have paid over the last six years." I then go on to say that the 40 days in which to send me a list of all charges, dates back to my original letter of 5 april
Feedback would be much appreciated, as aiming to get in the post tonight and then off to put the cheque in my new bank account. xxBack in debt, but refusing that let that smile be turned upside down!
Not as bad as the original £23k, but here goes:
Next Directory - £799 - 26.49% HSBC Credit Card - £720 - £24.9% Barclay Credit Card - £900 -Mum - £1379 - 18^ (not mother hen charging, but her credit card!)

allocations questionaire.
Someone suggested sending this letter (or one adjusted to fit your situation) to LLoyds Solicitors with your copy of the questionaire.

Re: your name –v- Lloyds TSB Bank plc
Claim no: xxxxxxxx
Dear Name
With regard to the above case, I enclose a copy of my Allocation Questionnaire, which includes a request for directions, also enclosed, to be ordered requesting full disclosure within 14 days. I have submitted these documents to Huddersfield County Court today.
At present the claim stands at £amount which includes the initial claim and the court fees.
The reason for this contact is to give your client another chance to settle before additional costs are added to the claim and more of the court systems time is wasted. As I am a member of the Consumer Action Group and money saving expert, I do not know of any cases that you have actually been to court to defend.
I will be including this letter in my evidence to show that I have tried to communicate to negotiate an early settlement, and to show the judge that I believe the way you are handling these cases to be ‘An abuse of the court system process’
If you wish to contact me to arrange a settlement please contact me on xxxxxxxxx to do so.
Yours Faithfully

That looks fine but it might be a good idea to bank the cheque first incase they cancel it, sorry but I don't tryst Lloyds at all....0 -

Hi Liddled, that's a brilliant idea - thanx, didn't even think of that. Will be hot-footing it to bank tonight and will issue letter once cheque has cleared. xBack in debt, but refusing that let that smile be turned upside down!

Hi,
I'm new to these boards altough I have been lurking for a while.
A few weeks ago I posted my first letter off to Lloyds TSB claiming for £2213.66, I recieved a standard reply stating that all charges are lawful etc, so I wrote a second letter (from a template) without prejudice for £2000.00. I am now waiting to hear back from them. I have a Gold Account which I have tried to downgrade but no-one seems to want to help me do that. I have not included the account charges in my claim.
My question is, I have a large amount of unpaid direct debit charges for high amounts, for example last week the bank charged me £210 for one charge before any direct debits were taken out. Is this allowed??
I am really confused on all my charges, I do want them back but am worried about the long process I have in front of me.
Thank you for your help in advance.
Victoria
Can anyone help me??
I have managed to get an appointment to see my account manager tomorrow afternoon to see what we can do to help me out.
Sorry to be a pain - I just really need help!!!0 -

FIRSTLY I would cancel any direct debits you have coming out of your account - that way it will stop any further charges - contact companies you pay by direct debit and arrange another form of payment (for the time being until your back on your feet)
2ndly - im almost sure you "account manager" will probably try and talk you into a loan (seems to be what they do) - personally i wouldnt bother going in to see the bank i am sure they'll tell you the charges are lawfull etc etc and you'll come out feeling like you cant claim anything.
remember you are entitled to your money back - be positive and dont let LLoyds tell you anything other than that.0 -

Thank you for your advice, I was thinking of changing my direct debits into my husbands account for now - I was really going to argue my case about how high the charges are, I will never get myself sorted if they keep charging me random but high amounts :mad:0 -

think you'll get no where fast with them - we are all in same boat - they really dont care do they - they'll just try and get you in more debt by offering a loan (im 90% sure that will be there suggestion - and why should you get in more debt because of the charges they illegally u charged you in 1st place)
i'd just stick to your guns - see if you can extend overdraft or something and make sure you add these charges onto your claim0 -

Lloyds tel number is 0121 633 5476 - try the nicely nicely approach - explain its coming up to 40 days you understand there really busy but would appreciate if they would do yours seperately - nice normally works with lloyds statement folk (prob cause there sick of people ringing them with a not so nice attitude lol)
would also state you want 6 years (as they normally send out 5 and then tell you in the letter it'll be another 40 days if you want 2001-2002 statements)
no idea on halifax sorry0
