Hi fellow LLOYDS victims!
I filed my Moneyclaim claim on 19th MARCH, taking it to SAT/SUN for it to be received after the 5 days were up.
They of course ackowledged it within the first 14 days, giving them the second 14 days in which to file a defence. They have not filed a defence so in theory I should be able to start my Judgement TODAY. However, it says I cannot do this yet as not enough time has passed.
Can anyone tell me how long I have to wait now? 2 of my other claims have both gone to Allocation Questionnaires so I thought I was lucky with this one, now I don't know what to do!
Any help is much appreciated, thank you!0 -
Has anyone had sucess with LloydsTSB. I have just sent off for a statement of my charges under the data protection act. I would like to know who has managed to get their charges back from Lloyds?
Yes i have...i had to send about 5 letters...(all the 2nd template letter) they said No firstly then after a few more letters they refunded £750 of the £800 asked for :T0 -
Hi everyone,
Wondered if someone could tell me if I am being fobbed off.....I have written to my bank, Lloyds TSB, requesting repayment of charges - fees for going over my agreed overdraft and non-payment of DDs/Cheques....this is the response I have received....at least I think this is the para that basically says no!
“The Office of Fair Trading has published new guidelines on credit card default charges. We’re still taking it through with the, but the important point is that the guidelines are about “default” charges that people pay when they break an agreement with us. This doesn’t apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you haven’t broken your agreement. They are our prices for the service we provide in these situations.”
Any help would be very much appreciated!
Many thanks,0 -
This is the standard fob-off letter that all Lloyds claimants receive.
Don't be put off by it - proceed with the next stage.I am a Travel Agent My company’s ATOL/ABTA numbers are E7760/3970. MSE doesn't check my status as a Travel Agent, so you need to take my word for it. Atol numbers can be checked with the Civil Aviation Authority. After hours of reading these posts, Lloyds must be the hardest bank to deal with, I have now had the transfer of proceeding letter ......so all the way for me and my claim. I'll let you know what happens next ........

Hi chomps,
Unfortunately you can not enter judgement on a weekend, so you will have to wait for Monday. No doubt Lloyds can and probably will put a defence in at the last minute.
Good Luck

I put my second letter in some time ago, before the arbitrary deadline they set and received no reply. I sent a copy of it just before the deadline in the hope of a response and still got nothing. Pressure of work means that I haven't had time to start the court proceedings bit - is that going to be a problem? I keep meaning to do it, then work takes over and I never do.
Any advice would be appreciated and I WILL get things moving!0 -
Hey all,
Lloyds do seem to really drag this out to the death!
Just to let you know where I am in my pursuit against Lloyds.
Sent of initial letter asking for charges back on 05/02/07 (Fobbed right off)
Sent letter before court action on the 21/02/07 (No reply)
I had to wait until I got paid to fork out £120 needed to file court action.
Went through MCOL on the 21/03/07 which was acknowledged on the 03/04/07.
Defence put in by Lloyds on the 09/04/07. Grrrrr!
Soon after I received a notice of transfer letter from MCOL stating this is being automatically transferred to Worthing county court.
On friday 20/04/07 I had a letter from the court (Notice of allocation to the small cliams track).
The letter says District Judge ****** has considered the statements of case and allocated the claim to the small claims track.
The hearing of the claim will take place at *** on the 4th June at stated court and should take no longer than 5 minutes.
Really happy as I thought the court date would be in July sometime, I'm also happy that I did not have an allocation questionaire to fill out!!
I am claiming £1800.00 which inc interests + costs, I keep checking my a/c to see if they have paid up but as yet they haven't.
My advice would be to go all the way and don't be tempted to drop the case through fear of not wanting to go to court, it won't happen..
I will keep you all posted of what happens next?
Good luck

Chris as you say it was some time ago, I would send 1 more letter threating court action giving Lloyds 14 days to respond. Knowing Lloyds, they will not reslove the issue. Then go in for the kill and file court action!
By sending the letter the judge would see this as reasonable.
I would also double check the dates of your charges in case they are passed the 6yr deadline, just a thought!
Good luck
