Hi fellow LLOYDS victims!
I filed my Moneyclaim claim on 19th MARCH, taking it to SAT/SUN for it to be received after the 5 days were up.
They of course ackowledged it within the first 14 days, giving them the second 14 days in which to file a defence. They have not filed a defence so in theory I should be able to start my Judgement TODAY. However, it says I cannot do this yet as not enough time has passed.
Can anyone tell me how long I have to wait now? 2 of my other claims have both gone to Allocation Questionnaires so I thought I was lucky with this one, now I don't know what to do!
Any help is much appreciated, thank you!
Let us know if anything was filed by Lloyds they normally wait until last minute then go for the next 14 days, then enter a defence and don't turn up.
Why can't they just pay up it must be costing more for them to drag it out.0 -

Started to claim back my charges of £1,100.00 in Jan 07, and have followed all the steps recommended on this site. Claimed through MCOL on 3/04/07. Notice that Acknowledgment of Service has been filed which I recevied on Friday 20/04/07 stating they intend to defend the whole of the claim, then on Saturday 21/04/07 I received the following letter from Lloyds, Central Fulfilment Unit AVA Overdrafts:
We have been looking at the details of your current account and realise we owe you an apology and a refund. The purpose of this letter is to explain what has happened and what we are doing to put it right.
One of the benefits of your account is an interest free zone within your overdraft. Through a process review we have identified that we had not set this up for you so you have paid interest and charges you should not have. To put this right quickly for you we will be making a refund of interst and charges. A refund of £291.78 will be in your account by the 17th May 2007.
The letter then goes on to reassure me that my £250.00 interest free overdraft is now set up correctly! There is no breakdown of what charges this relates to. What do I do now? If I accept this money do I jeopardise the rest of my claim?0 -
Hi all new to this Forum today thought a few people would be interested to read what llyods tsb are trying with me......
After checking all my charges on my online banking sent my 1st letter off recorded delivery to my branch on 19th of March for around £2000 in charges, Around 10 days letter got the standard reply back from Andover telling me they would look into it due to lack of funds as i'm on a payplan agreement to pay off my debts i decided to give them the four weeks that they asked for in there letter to reply.
Last monday i recieved a tsb credit card statement for which i owe £1,900 on telling me that i was £40 in arrears which was wrong as under my payplan agreement with them which has been running for 18 months now i am paying them back £5 a month, When i rang to challenge this (call centre on the other side of the world.....) they told me that the £5 a month was no longer acceptable (funny how since i put my claim in they say this.....).
Then last friday i got a default notice telling me unless i pay the arrears by the 30th of april they will file the default.
Today i then recieve my 2nd standard letter that plenty of people seem to be getting now telling me these charges are for there service and that unless i reply to them before june 6th they will close my case.
So to all you doubters out there keep going as it seems Llyods Tsb want to play dirty, Today i will be sending my 2nd letter off threatening court action unless they repay my charges and then if need be i will borrow the fee from family to go to my local court and file a claim.
Good luck to all in our fight against Lloyds tsb to get these charges back.0 -

Hi, I've just read Ruby's posting (quoted above), and I'm really confused by Lloyds TSB too. I sent the 1st letter to Lloyds requesting a list of all charges 3 weeks ago, I haven't had them as yet, but on Friday I came home to a similar letter to Ruby's with a cheque for £293.10. To quoute them:
"your account had entitled you to an interest free zone within your overdraft. Through a process review we have identified that we do not set this up for you, so have paid interest and charges you should not have. To put things right quickly for you we are making a refund of interest and charged, please find enclosed your refund cheque for £293.10"
If I cash this will I be jeopardising the claim I intend to make in the future, or can I reply to this letter saying that although I accept this cheque, I only accept it as part payment for a claim I intend to make? I'm really stressing about this, could do with the £300 as I've just had a gas bill for £1100 (estimated wrong for a while), but obviously I believe I can claim more so don't want to mess that up. Accept the money but only as a part payment and without prejudice and inform them by letter that you will be claiming the remainder in court.
I wish they would offer me something, their time runs out on Wednesday when I will then file for court action.

Can anyone advise me what I should claim for. In the letters to Lloyds TSB I requested that they pay back the charges but I did not include the interest. Now that I'm due to go to court can I add the interest onto my claim.
Also I requested that they pay back my charges only for the last 3 years as this keeps me below the £5000 of small claims court, when I go to court can I now request the full amount or will I have to go through all the initial letters etc again.0 -
Seems to me we are all in the same boat with Lloyds taking it to court stages.

just wondering as it seems there latest tactic is to go right to the end where we have to actually go to court to be told we have won.
Prior to that they seemed to be paying up before it actually got to going into the court.
To hear some stories of people getting money before they put in a defence would help lighten the mood me thinks

I agree whats the point they are only trying to make a couple of months interest from our money and thats not going to be more than the court costs and all the extra paperwork so why???
Other banks are paying out straight away a colleague of mine was payed by Barclays after her fist letter.

Im in the process of claiming back 1700 for my MIL but im worried she won't take it any further of fear of having to go to court
She already had her 6years worh of statements so we sent off the 1st letter,asking for the charges back...they replied quite promptly saying sorry she wasn't happy and they were looking into her complaint blah blah blah...when there time was up we sent the 2nd letter saying that as she didnt recieve a satisfactory response,if they didn't pay up within the next 14 days she would start court proceedings against them for the money. Again,they replied quickly but with another fob off letter! Feels like we not getting anywhere atall with this and MIL is getting freaked about the prospect of going to court. What do we do now..the last letter we sent to them stated that if they didn't pay up within 14 days we would start the court proceedure going...guess that means that thats what we have to do? Or do we write again giving them a final 7 days first?
Another question...if she does end up having to go to court (if she continues,that is!) does she have to speak atall,y'know,state her case ect...and how long will it go on for? She suffers with bad arthritus,mostly in her legs so when she goes out anywhere its in a wheelchair as she struggles to walk...will this mean she might not have to physically go to the court itself?
Sorry for long post but I really want her to win this,she deserves it so much and really could use abit of good fortune at the mo.

I'm new to these boards altough I have been lurking for a while.
A few weeks ago I posted my first letter off to Lloyds TSB claiming for £2213.66, I recieved a standard reply stating that all charges are lawful etc, so I wrote a second letter (from a template) without prejudice for £2000.00. I am now waiting to hear back from them. I have a Gold Account which I have tried to downgrade but no-one seems to want to help me do that. I have not included the account charges in my claim.
My question is, I have a large amount of unpaid direct debit charges for high amounts, for example last week the bank charged me £210 for one charge before any direct debits were taken out. Is this allowed??
I am really confused on all my charges, I do want them back but am worried about the long process I have in front of me.
