    you defo can claim - dont let them scare you.

    read some of the sucess stories on this forum and you'll see wht your bank said is the normal scare tactic all banks use on people to try and stop them claiming

    just keep calm and get advise off people on here and get your money back

    remember its your money and they'll try all tricks in the book to get you to think your not intitle to it back but YOU ARE

    Have you had any further news from Lloyds TSB your court date must be approaching soon.

    Has anyone emailled Lloyds TSB, I have an email address and don't know if its worth while chasing them up. They have until 25th to answer my final letter before I proceed with court action. Does anyone have any suggestions.

    I'm filling out the court claim form but got a couple of questions. In the Particluar's of claim i have used this template.

    The Claimant has an account XXXXXXXX with the Defendant, opened WHAT DATE. Since WHAT DATE the Defendant debited charges and interest in respect of purported breaches of contract.Defendant is aware of all details as a list of charges has already been supplied. Claimant contends: The charges exceed the Defendant's losses caused by the breaches; The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. Claimant claims: return of the amounts debited of £XXXX; Interest per S.69 County Courts Act 1984 of 8% - £xxx [enter interest total at date of claim] continuing at 8% until judgment or settlement at a daily rate of £0.xx; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court.

    Can i claim interest if i didn't when i sent my first letters to the bank?

    How do i calculate interest?

    anythings worth a try although i wouldnt hold your breath where LLoyds are concered as you may passout :rotfl:

    im at court stage they have till 24th to acknowledge or defend - fingers crossed they dont bother and i can win without hassle!!

  • I emailed lloyds 3 weeks ago, it took them 3 weeks to reply and even then the reply wasn't relevent to the question, good luck!

    If you don't remember the account opening date, leave it out, the info is of no consequence to your claim. The Defendant debited charges since the date of your first charge.
    Yes you can claim interest, use the interest calculator in Martin's article on the front page - just put in every charge with amount and date and it will calculate the total for you.

    I have just spoken to the person at our local court regarding the court papers and asked her about the time it takes. She explained that they initially get 14 days and if they retrun the response form they can extend this to another 14 days.

    She did say however that not everyone is successful, has anyone else heard anyone that hasn't been, or do you think that she is mistaken.

    This is worrying, I'm just about to start MCOL and I'm feeling nervous enough without reading that!

    I always read the success thread and don't seem to find many recent success stories regarding Lloyds.

    I really am beginning to doubt myself on this one, Halifax paid up £2,300 without MCOL so it's new territory for me.
