I have just posted this on the MCOL thread, but wondered if anyone had experienced this with Lloyds!

Just a little question...
I filed a claim with MCOL on the 4th April.... Lloyds have put in a defence already - as of yesterday (17th April)!
I think, from what I have read, that this hasnt been left until the last minute by them - considering there was also Good Friday and Easter Monday in the middle of it where everything shut down etc....
By my workings out, they had until the approx the 23rd April to defend (taking in bank hols etc).
Does this seem a little strange to you, or possibly are they using a different tactic?
Anyone else seen this from Lloyds??
I don't think i'm complaining about them putting in a defence earlier..... as it means the ball is rolling and we're getting on with the claim... but just a bit confused.

Just to give a little reassurance to those of you who forgot like me to put sort code and account number on mcol, i have just phone norwich county court where my claim has been transfered to and the chap advised me no problem just send in covering letter with AQ alsoinquired about court bundle and said i could send anything relative like spreadsheet of charges and copies of statment of charges too. this is a bonus as i thought i was about to chuck more money at them to adjust claim. hope this helpsJen0

Hi, I'm not too sure as to my next step. I think I need to send the second letter theatening court action. I sent first letter to Lloyds/tsb approx 10 days ago with a copy of the figures from the calculator after receiving the details from my statements. They have sent me, what I think is a fobbing off letter back this morning, but I just wanted to check that I had the right end of the stick and should continue by sending the second letter about court action. I am very nervous but am determined to continue and it really helps knowing that so many of us are in the same boat. I will have to type in letter received this morning (I'm a bit of a technofob aswell) so apologize for any spelling mistakes. If someone could just confirm whether I am correct in my next step I'd really appreciate it. My letter was as follows...
Thank you for getting in touch with us. I am sorry you are unhappy about your account charges.
Like any business, we do make a charge for some of our extra services. When customers don't have enough in their accounts to cover a payment, this always means extra work - and it has to happen very quickly. We have to agree to make the payment by setting up or increasing an overdraft, or tell customers we cant't agree it. We feel it's fare to charge for this service.
Of course it's only fair too, that we're completely open about any charged-for services before you might need them. That's why we take care to give every new customer the latest guide to our charges. You can also get up-to-date details about fees and borrowing rates at all our branches, through our helpline and on our website.
Just as importantly, we do everything we can to help our customers avoid these charges. You can get an up-to-date balance at any or our cash machines, over the phone, on line and by weekly text to your mobile.
If you know a payment is going to take you over your agreed limit, your're welcome to see if there's anything we can do.
The Office of Fair Trading has published new guidelines on credit card default charges. We're still talking it through with tem, but the important point is that the gudelines are about "default" charges that people pay when they break an agreement with us, This doesn't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you haven't broken your agreement. They are our prices for the service we provide in these situations.
I understand that you may also have some concerns about us sharing information about your relationship with us with the credit reference agencies we use. I'd like to reassure you that this does not apply to bank charges; we only share what is known as white data, which is information about payments to your credit card, loan or mortgate accounts.
I do hope you can see that we make our charging system as fair as possible - and why I can't agree to cancel your charges.
I hope this fully answers the points you raised with us. Please let me know if there is anything else I can do to help. If we cannot come to an agreement, I will provide you with details of the Financial Ombudsman Service so they can consider you complaint independently.
If you are happy with the way I have dealt with your complant, there is no need for you to reply to my letter. If I have not heard from you by the 11 Jun 2007 I will close my file, though of course I will re-open it should you come back at any point afterwards.

Iv just nipped over to court to see what was happening they said that they received the defence from Northampton on Friday and its now gone to the Judge for directions. I should hopefully be hearing something in the next week or so ie whether i need to fill out a AQ or if they have been dispensed with and will go straight to a hearing - ill keep everyone posted0

currently my charges per online statements is
account 1 : overdraft excess fee £240
unpaid d/d £172
copy statement £10
total = £422
account 2 : overdraft excess fee £260
unpaid d/d £609
total = £869
therefore total charges are £1291 and they have offered £750.
can i reclaim all the excess overdraft fees as well as the unpaid direc debit fees?

hi there charmed3....i recieved the same letter back in feburary so my advise is to press on with 2nd letter having said that i had no reply to that after 14 day deadline so had to go to mcol i'm now at stage where they have defended which is also the norm..hope this helpsJen0

yes you can claim excess overdraft fees and direct debits too but not overdraft interset fee or account charges if you have a select or gold accountJen0

is there a template letter i use now to accept the £750 as part payment and request the balance of £1291-£750?

soz julz not sure about template letter for 750 as i've got to court stage and not had any offer but on other posts peeps are saying send letter to lloyds state thank you for the £750 which you will accept as part payment but will be pursuing through courts for balance ...oh and say without predudice.also all my contact has been through Andover call centreJen0

Has anyone here had to send in the bailiffs yet? My court claim has been completely ignored and am still waiting now after requesting judgement by default. Not sure what is going to happen next?0
