I have sent them a final letter demanding a payment in which their time will be up next Wednesday then I will proceed with the courts, I have all the forms etc ready to go. I haven't yet had the offer of £750 but understand that alot of people are now receiving this.

They owe me alot, but the information I sent to them did not include the interest I was only going to claim this if it went to court (can you do this).

Good luck with your case, we should all get together when this is over and have a party!!!!!!!!!!

Hi hookys1 I did my claim through the Money Claim Online so don't know if it's the same process as going into the court with paperwork? But to give you an idea of time scale :-
    Claim filed online 12/3/07
Letter dated 23rd March from Llyods with offer of £750
Letter dated 26th March I wrote back not accepting as full and final settlement etc
Letter dated 26th March from courts ref.Acknowledgement of service from Llyods, which gave them 28days from date of filed claim to put in a defence.
Court letter dated 31st March ref.Notice of transfer of proceedings and Llyods Defence.
Lastly today received letter from my local court 'Allocation to small claims track and hearing date!!!
Not sure it thats of any help to you?? Suz

Party sounds good to me, we will need it when this is over are nerves will be shattered!!!! Yes i only claimed the actually default charges and not interest i presume the interest does get added if you go to court, but not sure if the courts automatically add it on or you have to work it out and add it on??? Wish you all the best with your claim, let me know how your getting on ok SUZ
  • Hi Notepad Here

I too am going through the process of claiming over £3000 I've issued the court proceedings and received three replys back all stating their still looking into it. The court time limit is up on 22/04/07 and they say if i'm not happy contact the ombudsman. I think they are stalling me hoping I will go away, no chance but I would like to know what to do next

hi, i too am having trouble with lloyds tsb. im only claiming for about £250 but i feel i shoud out of principal plus the fact that most of my charges have exceeded the 6 yr mark so anything i can get is good. ive sent them the 2nd letter and am expecting the same response i got from the 1st that i sent.

the trouble is that i know nothing about the small claims court and am struggling for information on how to take the next step. i have seen the claims note but have no idea what to do with it. thanks.

plus as im here does anyone know the address for studio cards as ive paid alot of late payment charges to them and ive read on here about people claiming.

    many thanks

    Hello all.

I am about to use the charges calculator, having had my list of charges from Lloyds TSB and send the letter asking for a refund.

I am stuck though. I wondered if someone could tell me if I should be reclaiming the charge for the Select account, which, for seven pounds per month (sorry - my pound sign key isn't working for some reason!) gives me a few bonuses - credit card protection and AA Breakdown Cover.

I chose to pay for a Select Account (bit steep for what you actually get!) so I presume the monthly charges for the benefit of having those perks isn't refundable -so when I am adding up the charges I don't include those monthly Select Account ones? (7x12 = 84 pounds a year.)

LloydsTSB are entitled to keep that - yes?

    Thanks for your advice.

However I found it was much easier to sign up for internet banking with them (assuming you still bank with them) - go to ltsb website click on personal banking/log on, will ask for personal info, you then get sent a letter with user id and instructions on what to do then. they ignored my request for statements despite two polite reminder letters of when the 40 days would expire, but i signed up and accessed statements online within a week.
  • I have written with request for refund of charges and have a reply saying

"..the important point is that the guidelines are about 'default' charges that people pay whey they break an agreement with us. This doesn't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you haven't broken your agreement. They are our prices for the service we provide in these situations."

Is this a standard reply to baffle me, do I have to justify to them that they are default charges??
