    im not 100% sure so dont quote me - but read on another thread that when it happened to them they rang up the bank asking when money would be paid and that you had the judgement, the bank asked for a faxed copy and then paid out.

    so i think (i repeat think) that once you have copy of judgement thats route you go to - saying if they dont pay out then you will send in baliffes which your sure the news papers would be interested in (obviously use that if they be funny with you)

    Can someone please help me? I'm really stuck with the whole thing and seem to be losing track of what the process is. I sent the first letter on the 4th march requesting a list of charges with the £10 cheque to the Customer service recover centre at 125 Colmore Row, Birmingham. This is as far as i have got and HAVE NOT heard back from them even though its gone past the 40 days as specified in the letter. Was this the right address? Is there anyway of phoning them?
    I am getting really confused and as much as i would like to read through the millions of pages on these forums I physically don't have time to... lunch break is over in a minute. Would anyone be willing to offer me a step by step guidance once i have completed each stage?
    Thanks so much for any help and advice in advance.

    this is the copy statement tel no - 0121 633 5476 - its based at swallow house, 10 swallow street , birmingham

    i would ring them, be all nicey nicey, sympathis with them - say your bet there sick of calls, you understand they have a back log etc etc then tell of situation and ask if they'd possible be able to sort your statements out seperatly as you have now been waiting over the 40 days which is what they have by law to send them out - tell them you want the full 6 years (not the normal 5 they send) - try nice approach - luckily i got my statements beg of year - however they missed off 2001 so i rang up and they said they couldnt deal with individual cases - so turned on the charm (as thought they prob just get people being nasty to them all day) and lady was then lovely took my account number etc and had them withint 2 days.

    worth giving it a try - also fax number i fyou need it is 0121 633 5443

    other option is register with online banking (if you havent already) and you can look back at upto 5 and a half years statements online. dead easy to do - can look at charges only which makes is really easy

    go to home page on here - then click link in middle of page about re claiming bank charges, it then gives you step by step on there.

    if you want to push it forward faster - miss out first letter asking for them back (as TSB NEVER pay out on letter one) and go straight to letter 2 - asking for charges back otherwise you'll go to court (give them X amount of days - your shout as to how long you want to give them) - once that date comes (i can guarantee you you will receive a standard thanks but no thanks letter) then go to https://www.moneyclaim.gov.uk and file a claim to get money back

    tsb nearly always go to court.

    SEND LETTER(S) RECORDED DELIVERY TO LOCAL BRANCH (or hand deliver them - getting a receipt)

    im at court stage with tsb and playing the waiting game - so i can only help up to this point
  • The story so far.... I filed a claim at the county court on 26th March, since then I have received one letter from YB to tell me that they will be defending their position. The 28 days elapsed on April 18th with no offer or contact from YB. Today I have received a letter from the court explaining that YB have filed a defence and that I have to fill in an allocation questionnaire, which includes questions on witnesses or expert reports that I want to submitt to the judge when he hears the case. It also explains that I have to pay a further £100 court costs or the case will not proceed. My dilema is this, I have followed the advice on this web site to the letter and wonder if there is anyone who can advise on what I do next. I want to fight this because the charges are grossly unfair, however, another £100 to pay and if I lose what will it cost me ?
    Is there anyone else out there who has had to go to court and if so what are my chances. ?:confused:

    The guide to the Allocation Questionnaire is in the Reclaim Help Thread linked in my signature. The extra £100 is payable if your claim is more than £1500, link the the above thread also regarding court costs and exemptions if you are on any benefits.
  • Hi i have had a refusal letter. Is it that iam trying to reclaim something i cant, or is it the bank just trying to put me off claiming help needed please
    the bank is lloyds tsb my charges are from 02.11.01 to present date

    here are the charge types iam claiming for (in sttements they are al listed under charges column)

    overdraft usage fee
    overdraft excess fee
    unpaid dd


    here is the letter I recieved

    "Thank you for getting in touch with us. I am sorry you are unhappy about your account charges.

    Like any business, we do make a charge for some of our extra services. When customers don't have enough in their accounts to cover a payment, this always means extra work - and it has to happen very quickly. We have to agree to make the payment by setting up or increasing an overdraft, or tell customrs we can't agree it. We feel it's fair to charge for this service.

    Of course it's only fair too, that we're completely open about any charged-for services before you might need them. That's why we take care to give every new customer the latest guide to our charges. You can also get up-to-date details about fees and borrowing rates at all our branches, through our helpline and on our website.

    Just as importanly, we do everything we can to help our customers avoid these charges. You can get an up-to-date balance at any of our cash machines, over the phone, on line and by weekly text to your mobile.

    If you know a payment is going to take you over your agreed limit, you're welcome to see if there's anything we can do.

    The Office of Fair Tradng has published new guidelines on credit card default charges. We're still talking it through them them, but the important point is that the guidelines are about 'default' charges that people pay when they break an agreement with us. This doesn't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you haven't broken your agreement. They are our prices for the service we provide in these situations.

    I understand that you may also have some concerns abot us sharing information about your relationship with us with the credit reference agencies we use. I'd like to reassure you that this does not apply to bank charges; we only share what is known as white data, which is information about payments to your credit card, loan or motgage accounts.

    I do hope you can see that we make our charging system as fair as possible - and why I can't agree to cancel your charges.

    I hope this fully answers the points you raised with us. Please let me know if there is anything else I can do to help. If we cannot come to an agrement, I will provide you with details of the Financial Ombudsman Service so they can consider your complaint independently.

    If you are happy with the way I have dealt with your complaint, there is no need for you to reply to my letter. If I have not heard from you by the 11 Jun 2007 I will close my file, though of course I will re-open it should you come back at any point afterward.

    Don't worry. It's just the bank trying to scare you off. You're not challenging their right to charge you but the amount of the charge in relation to their costs, so the points they make in the letter are irrelevant.

  • hi charmed3 iv had exactley the same letter today.word for word so iv done the second letter on the template.im trying to claim £700 of lloyds,but £200 of it is for an savings account that they closed down without telling me and just took my £200 out of it that was in it,that was because i was behind on a credit card payment.so to me thats stealing so im trying to get that back..what are my chances?
