I got my boss to have a look at the AQ and if you tick what track you want it to proceed in ie small claims fast or multi - small claims is the one you need to tick (this is if you are claiming less than 5k there is no fee for this AQ - if you want it fast tracl then its £100.00 - check with the Court it is a bit of a bind having to pay the £100.00 but all being well you will get it back plus the £120.00 issue fee0

Hi Please Can Anyone Help? I'm With The Yorkshire Bank And Have Tried Claiming My Charges Back.i Have An Overdraft And Have Been Charged £8 A Day When Overdrawn And The Odd £20 And £25.the Bank Have Got Back To Me Saying The Charges Are Lawful And Are Not Going To Pay Me Back.
I Dont Know What To Do Now Because I Am Not Sure If I Can Claim These Back Or Not.

Don't panic. Deep breath. Follow the step by step article and read through the Reclaim Help Thread. You can claim these charges as long as they are not overdraft interest but charges for going overdrawn. But if the bank has already told you to go away you will have to file a court claim. It's nothing scary, tons of people, including myself, have done it and won.Reclaimed thanks to this site:

The sample letters are a good start, depending on what correspondence you sent to the bank before. You must give them enough time to react to your demand. Martin allows 14 days response to the first letter and 14 days to the second letter, in which you threaten court action. You have to follow through then, and from their response so far and from what I have skim-read in the thread, a court claim looks very likely in your case.Reclaimed thanks to this site:
