    Went through the process of sending letters and got nowhere so decided to go through the court. Just found out today that Lloyds TSB have put in a defence and the hearing is set for next Wednesday. Must admit i'm pretty worried.

    If anybody has been to a hearing before any advice would be much appreciated.

    Don't be too worried I have read many notes about them putting in a defence but they never seem to turn up, another delay tactic. I will be doing the same over the next few weeks.

    HI eveyone

    please can anyone answer these simple questions
    i went into to court today to fill out my claim and paid my £120.00 as i have done this are they liable to pay my interest and court fee if i win?
    also how long will it take now and what will the next step be the lady at court took 3 copies of everything and said i would get 1 copy back in about 3 days with a date on she then said they have 14 days to pay is this correct or not and if they intend to defend what timespan do they have and from what date, how long does it take to get a court date thanks

    Hi there Tiffney yes i got to defence stage from Llyods dated 31st March a very long winded 9 point defence from them i might add!!!! I then waited for further correspondance from my local county court because i did not receive 'an 'Allocation Questionare' with the defence, apparantly in some cases they are not using these any more? Anyway today i received a letter from my county court basically saying my hearing will be on 20th June and should take no longer than 15mins!!! Great....Not i'm very worried. Just wanted to say be prepared to have to go all the way with Llyods they certainly do not wish to make things easy for us 'Claimants'.Good Luck with your claim, let me know how your doing.;)

    Thanks Suz75 - Can it really be that dragged out?? I was hoping this would be coming to an end now the defence has been filed - do you know the options for Lloyds now they have defended?

    June the 20th seems a long time to wait for the court date do you know if this is normal.

    I recieved my Defence this morning (4 days before deadline) with the usual blah blah which is standard. I got my boss to have a look at his (i work for a law firm) who said its absolute crap and Kirstie Ross is prob some rubbish solicitor who cannot even be bothered to look at individual cases (if there is such a person ha) anyway going to be sending off my AQ soon but he said which is a big must when filling it out put that it is small claims otherwise a) if you lose you pay their costs and b) you dont have to pay the x amount to file the same - hes going to defend my claim so ill keep posted about the progress of the same
    Hi, you say in this post that you are to complete an AQ to ensure you get it correct, is this something you are doing as you are doing through MCOL? or is it something that we should all do 'cos I've not seen one of these and I'm about half way through my 28 days in court????

    Hi there no i'm afraid i don't know what their options are at this stage, but having read threads on this forum and on 'Consumer Action Group' forum, i've read that Llyods don't actually intend to turn up at Court (I may be wrong) they just send in a statement letter, which having read my letter from county court us the 'claimants' can do as well if we so wish!! Must admit i am very nervous now was hoping it wouldn't come to this stage!!! Going to have to get my court 'Bundle' perpared now..Yikes...

    You can accept this but ensure that you inform them that this is only accepted as a part payment and without prejudice and will be persuing them for the remainder.

    Hi there Liddled i have no idea whether this is a long time or not, this is all new to me as well, really didn't want to get to this i thought they would have paid up a long time ago!!!! Obviously they want to make us suffer... But i'm gonna stick to my guns and go all the way. I wanted to say as well i did received the 'Goodwill Gesture' of £750 but wrote back saying wasn't accepting it as FULL and FINAL settlement but would accept as part payment of my £1486 claim. What stage are you at?? Suz
