I'm about to start the same process next week, I think that you should go for it, they would have no feelings if they were doing it against you.
Other banks appear to paying out very quickly, a colleague of mine has sent only one letter to Barclays and the first response letter included an offer, why can't Lloyds TSB be sensible like this, in the end they know they have to payout.

Hi there,
I sent the initial template letter to Lloyds last month requesting account details with the £10 cheque. I have not heard anything back and it has just gone over the 40 days that is given in the letter. What do i do... do i try and phone them? I haven't checked to see if the cheque has gone out but what if it has? What shall i do?

They don't appear to be doing their requests in any specific order, I sent my request letter to them one week after my brother, I've had mine returned and he has hasn't heard from them yet. I know someone else who had theirs returned within 3 weeks there doesn't seem to be any method. Sorry not to have any good news for you.0 -
I sent my second letter to Lloyds last week threatening court action. I received a reply today saying
"the important point is that the guidelines are about "default" charges that people pay when they break an agreement with us. This doesn't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you haven't broken your agreement. They are our prices for the service we provide..."
I take it that they are trying to scare me (don't tell them but it's working. a little bit.) and this is a standard letter?0 -

Wait the 14 days, then send the LBA (amend it to say 14 days, not 7 (if that's what it says)), THEN file, preferably with an N1 rather than MCOL - you can include a schedule and other info that you simply cannot fit in the box on MCOL).
The Civil Procedure Rules state that 28 days must be given in respect of legal action. Lloyds are know to play dirty - they could potentially get your claim thrown out on the grounds of not enough notice if you only give them 7 days after the initial 14.0 -

Go straight to the information commissioner and report them - it will cost you nothing and in a day and age where ID fraud is on the up, it's your civil duty to do so - this sort of thing is happening far too often. Banks have a duty of care that they are blatently disregarding and they need to be made to actually care again, like they used to.0 -

I have had exactly the same letter and I'm ignoring this and proceeding. In fact the letter they sent to me was dated the 30th March 2007 and I only received this on 11th April 2007, therefore I think they maybe back dating letters or delaying sending them out.0 -

Hi , need some advice on this one please, I am claiming £4500 from the Tsb and have been on money claim online and my local court, I have handed my Allocation Questionaire into my local court.Now the Tsb soliciters have offered me a out of court settlement for the whole amount which i have agreed to , meanwhile Tsb have sent me a letter saying they will give me a goodwill gesture of £750 and thats all.They said this was their final response to this matter and now have put the £750 into my account, I have already agreed with their soliciters to the £4500 amount so don't know what to do now.Any advice would be truly appreciated.0
