    Why did you request copy statements and then trawl through on t'internet? You could've saved time by choosing one method.. and possibly money!!

    Copy statements can be ordered via branch (quicker than writing to copy statements unit) and whilst copy statements are generally charged for a maximum of £10 will get you a full list of charges for the last six years. Also you have copy staements only going back a maximum of 5 1/2 years(as they only gave you the option of 1 September 2001!) when you could have reclaimed another 6 months worth!!!!!!!!!!!


    Why don't you follow the advice comprehensively???

    hi yes i no i wasted soom time but they went past there 40 days time limit so thought i wud try n rush things up but it did the trick so hopefully they will pay up......thnx

    I have just trawled through all my bank statements on line and I'm now ready to send my claim off, one account is with Llyods in Poole and one in Haverfordwest - confused where to send my request for my money back, should it be the recovery centre below?

    Hi all,
    I filed my claim direct with my local county court on Thursday 12th April against Lloyds TSB. for £4714.00+ interest.
    I was wondering if anyone knows if filing the claim direct with county court would make any difference to the time scale as opposed to filing with MCOL.

  • We sent ours to the branch that we use, but it doesn't really matter that much.
    the letter you get back saying our charges are fair blah blah comes from this address, so you could use this:

    Swallow House
    PO Box 139
    10 Swallow St
    Birmingham BX1 1LT

    (IGNORE THE LETTERS THEY SEND YOU, WAIT 14 Days, send the LBA, wait 7 days, then file with MCOl if you have not received an offer by then.)

    Can anyone give me an idea of likely timescale for my next stage?

    I had the standard fob-off letter and wrote back with my 'pay up or I'll start court procedings' letter giving them 14 days from receipt of the letter. I sent it recorded and have seen proof of delivery on the RM website. The 14 days are up on Wednesday so I intend to start MCOL on Thursday.

    What is the time scale with Lloyds TSB at the MCOL stage? I keep reading that they pay up at the 11th hour but how far am I from that? Weeks? Months?

    It then went onto give a breakdown of refund amount,contact details should I wish to contact them and and a line saying they had explained everything clearly.Also said my £250 interest free overdraft is set up correctly.

    No-where have they asked me to sign an acceptance form or even stated this is in relation to my pending claim.Has anyone else had such a letter from Lloyds?
    Is this a ploy to trick me into accepting?
    This weekend I was going to get down to starting the online court proceedings but this has thrown me a bit -is it a genuine banking mistake on thier behalf or something more sinister? Should I wait for this money to get to my account before continuing with the courtsAny advice would be great and sorry for it being a bit long winded - thanks for readig

    Did get round to calling them yesterday but was in a hurry so phone call was rushed.Apparantly it was a mistake on the banks behalf when I upgraded to a gold account and my free overdraft was set up incorrectly.Did say to chap on the phone that I was going through the claiming process and he said it wont make any difference to this payout - its unconnected.May be being over cautious but seems rather coincidental that after 5 years someone at Lloyds has noticed an error with my account.
    My main concern is - As I have not filed my online claim,so therefore the 27th April will be way before any court hearing - will this payout affect my case against Lloyds.Will their defence be able to turn round and say the £1572.79 is an incorrect sum,as they have already paid out £466.63, and attempt to get my case thrown out of court on a technicality.
    Tomorrow will bring another phone call when I will ask for a full and detailed breakdown of charges and interest of the supposed "windfall" coming my way.
    If anyone knows of any similar situations to the one I find myself in I would love to hear

  • Not had the same letter but I would think you just carry on regardless and just think of it as an added bonus - even though it was lawfully your money anyway.
    Take the person's name on the phone when you speak to them aswell especially when they say that its uncorrected with your claim.

    First they will acknowledge the claim, then file a defence that you will get a copy of from court, The court may then redirect the claim to your local court ( they did with mine ) and send you the AQ to fill in and return, then you wait for the response from the court while getting all of your paperwork and court bundle ready just incase.

    Thats as far as i am in the process so all i can tell you at the mo.

    UPDATE AND SOME GOOD NEWS

    Then they send a letter saying they still intend to defend the claim but WILL PAY UP as they do not want to be in dispute with their customers.

    The usual reasons for dispute are set out on it and so on.

    Letter arrived 7 days after date on letter so would think they are going through a few of these.

    No response from AQ yet, I had until the 14th to return it to court, but they have included some clauses which i am not willing to accept, so have written back saying I will accept payment BUT with no clauses involved, and also set a payment date for monies to be paid to account.

    This letter is also MARKED strictly private and confidential, strictly without prejudice, confidential and privileged, so it says, also states that i can not use this in court if it goes there. ( Is that true ? )
  • Iam almost finished now,Judge ordered a stay till 28 april.I got a letter from yorkshire bank saying.Your account is due for a review.We would be obliged if you would contact your branch.If we dont hear within 14 days your personal credit limit will be withdrawn in full andsufficent funds nmust be paid in to repay any debt balance outstanding on your account. I am overdrawn but am in my limit.So is this a scare tatic? As i have never had to review before. thanks maggie
