  • Hi i wish to start court proceedings with lloyds tsb, im getting increasingly annoyed with them!! can anyone advise me on this i called up- 5th time in 1 day!! they gave me lloyds tsb plc, box 1 bx11lt- which according to moneyclaim online is outside the uk, not allowed apparently, can anyone give me advice please please please!!!

    I sent a letter to Lloyds TSB using the template on this site requesting statements/ bank charges for the last 6 years together with my £10 cheque.
    This morning (after exactly 40 days) I received a letter back from them and they have stated that there charging system is completely fair and the charges I received for going over my agreed overdraft limit etc. was fair as these charges are clearly stated on their website etc. etc. The letter went on to say, basically that I hope I am able to see that any charges I incurred were completley fair. Also they didn't enclose the bank statements or bank charges which is what I originally requested- And now I don't know what to do! can anybody help?

    HELP!!!! Im panicking a bit now, lodged claim for £1900, acknowledged and now saying a defence has been lodged and can go no longer online. So now what happens now i am a bit scared now.

    Can any one offer advice please

    Hi,

    I currently have a claim going against Lloyds TSB for the sum of £577.63, I have recieved a first letter back from them stating that they feel the fee is fair and won't be paying, etc.

    I have since sent of the second letter and have yet to hear back from them, the two weeks is up this Wednesday.

    However since then, I have been hit by charges totalling £221.73 in the last two months. All of them completely out of order in my opinion.

    1: Going £755 Overdrawn, my overdraft limit is £800 so why would I be charged for still being in it?
    2: Direct debit not clearing - I was charged £65 for this well over normal
    3: Paying money into another account after my internet banking had shown a cheque to have cleared, which in fact had not. If I didn't have the money surely it shouldn't have been able to come out and send me overdrawn; a la direct debit unable to come out.

    I have a feeling these may be occuring because of my claim, has anyone else had this problem?

    Also if I wish to reclaim these fees do I have to start a seperate claim or can I write to Lloyds telling them I want them added to this claim?

    This is normal procedure. Once a bank decides to defend the case is transfered to a local county court. You will hear from the court and they will send you an allocations questionnaire which is very straightforward asking questions like do you intend to have witnessess or an expert in court. The answer is generally no. It will ask whether you are happy that the case is being heard in the local court and whether there are any special needs which may need to be addressed by the court. That is pretty much it. The case is very unlikely to get to hearing stage. In my experience the banks pay up before the day as they dont want a precedent in law to be established.

    Dont be scared this is what the bank wants. Those of us who have been through the process all remark how painless it all is. Just dont be intimidated, there really is no need. Good luck

    my partner has went through the reclaiming bank charges back online, and well you know the letters he would have got back so last weekend we started the court proccedings through moneyclaim a total of 4712 pounds from lloyds tsb, does anyone have any experience of lloyds tsb and moneycliam and what will probably happen any advice would be great

    Hi

    Have a look at the post by Busby1969 and my response to it above. My experience was with Lloyds TSB. They are likely to defend the claim and proceedings will be transfered to your local county court. However less than a week after handing in the allocations questionnaire at the court, I was paid.
    I just happened to notice that my online account had been credited the day before. It took nearly a week for written confirmation from the bank's solicitors and no acknowledgement at all from the bank itself.

    Good luck, I am quite sure you will get a positive result. I haven't heard of any negative ones yet.
