You need to be careful claiming charges that you actually haven't as yet paid as you say they will be coming off next month. By all means include these charges in your letter and say you will be adding them to your claim.0

Been going through the process of reclaiming money from Lloyds Tsb to the sum of £1572.29 (unauthorised fees plus interest)
Sent first letter 12/03/07 and got back basic letter saying they "we're very sorry blah blah ... looking into it blah blah..."
Sent next letter 27/12/07 stating that I was unhappy with the reply and would take them to court.However - I then offered them the chance to settle by accepting only the fees without interest.
Today in the post (14/4/07) I received another 2 letters.The first was another "we're very letter", the second was a bit more confusing and reads like this :
We have been looking at the details of your current account and realise that we owe you an apology and a refund.The purpose of this letter is to explain what has happened and what we are doing to put it right.
One of the benefits oy your account is an interest-free zone within your overdraft.Through a process review we have identifiedthat we had not set this up for you,so you have paid interest and charges you should not have.To put things right quickly for you we will be making a refund of interest and charges.A refund of £466.63 will be in your account by 27 April 2007.
To work out your refund we've gone back thruogh our system records for your account dating back to March 2002.This includes interest (annually) from the day the charge went onto your account,up to 27th April 2007
It then went onto give a breakdown of refund amount,contact details should I wish to contact them and and a line saying they had explained everything clearly.Also said my £250 interest free overdraft is set up correctly.
No-where have they asked me to sign an acceptance form or even stated this is in relation to my pending claim.Has anyone else had such a letter from Lloyds?
Is this a ploy to trick me into accepting?
This weekend I was going to get down to starting the online court proceedings but this has thrown me a bit -is it a genuine banking mistake on thier behalf or something more sinister? Should I wait for this money to get to my account before continuing with the courtsAny advice would be great and sorry for it being a bit long winded - thanks for readig

Just a quick question, i'm currently doing the HMSC Money Claim Online bit to take Lloyds TSB to court for my charges, I have to fill out the defendant part of the online form, for the address of Lloyds TSB(the defendant) do i use the head office address or my local banks address?

If you use your branch address it will leave Lloyds TSB with less time to respond (if they choose to do so) and therefore you are likely to win by default.....
The other side is that if you write to Gresham Street, London they may offer you a settlement before court!
Personally I would go for serving papers at their Registered Office - 25 Gresham Street, London EC2V 7HN as there is no way that they (LTSB) can put a claim for the judgement to be "set aside" for it not reaching their OFFICIAL offices.....0 -

I received my predictable response this morning.
Half of the B***sh*t they write is not applicable to my situation and tehy couldn't even get my address right!!!
CARRY ON REGARDLESS! The banks will all send letters to put you off and even more so now that even more people are starting to rewclaim the cash they have been cheated out of by these unfair charges!
- it would be an idea to have this standard letter put somehwere as a sticky as many posts are repeated by different users asking what it means..... even though they (forum users) should just take the original advice and respond accordingly using Martin's advice!

hi all finally recieved copy of statements this morning after printing them of from my internet banking took them in my local branch yesterday and the ones i asked for and paid for turn up this am what a coincidence??? any way covering letter they sent as follows....i refer to your recent request for copies of statements on your account to enable you to reconcile your bank charges. please find enclosed details of charges going back to the date you opened your account,or 1st september 2001, which ever date is most recent. if there are no charges for a certain period then charging details will not be included.you may now wish to procede with your claim for reimbursement of charges but,if you do feel you need further statements,this will take longer to access our archive data.please let me know by returning this letter in attached prepaid envolope and i will order then for you...... this is the letter that came with my statements so it looks like once i send them the amount i am claiming which is £255.00 not much finger crossed they might pay up without me having to file a claim just thought i would let all know ..... allso the addy which i got is lloyds tsb plc

Why did you request copy statements and then trawl through on t'internet? You could've saved time by choosing one method.. and possibly money!!
Copy statements can be ordered via branch (quicker than writing to copy statements unit) and whilst copy statements are generally charged for a maximum of £10 will get you a full list of charges for the last six years. Also you have copy staements only going back a maximum of 5 1/2 years(as they only gave you the option of 1 September 2001!) when you could have reclaimed another 6 months worth!!!!!!!!!!!
Why don't you follow the advice comprehensively???

I was wondering if this has happened to any one else. I have been helping my sons to claim back bank charges fron Lloyds TSB. We used the stage 1template from this site ( thank you very much for that ), sent off the letters, one for each of my sons. Two weeks later recieved one letter back, the letter was addressed to both of them Mr A and Mr B and inside were both the lads statements of bank charges. Surley they should not have been in the same envelope. These claims are not for a joint account but seperate accounts, surley this information is confidential and they should have each had letters addressed to themselves. Should they complain or is this practice legal. I would like to know what you all think?0

I'm not a lawyer, however surley this is against everything that the Data Protection Act stands for???
I'd check this out with a lawyer to see if there was anything you could do and if there is "take them to the clearners."0 -
You could report them to the IC as a breach of the act you can download forms from the site

Well,I took the plunge and delivered my money back please ,thankyou,letter by hand to the branch this morning.You should have seen the look on the cashiers face when I asked for a reciept for it.She opened it,read it and got a piece of reciept paper from the desk ,(after telling me she would have to pass the letter on.) Then she stamped it very heavily and sort of though it at me.I just laughed as I found it so pathetic.It was a bit nerve racking though.So,how long do I wait now till I ask for guidence on the next stage.0
