    It is very unlikely you will have to attend court. Many banks now settle anytime after the allocation questionnaire has been submitted to the day before the court date.
  • I have tried to get £630 back from Lloyds TSB and no surprise but they have rejected my claim saying that I knew that charges could be made so it is my fault...fair enough!
    If I now want to send the letter about taking them to court, what do I need to fill in where it says 'INSERT NAME OF COURT'?

  • I am looking at the standard templates on the MSE site for reclaiming bank charges and am up to stage 5!!!. It goes
    'This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the [INSERT NAME OF COURT] court will rule in my favour.
    I just dont know if this is my local court or the one that is online? New to all this sorry......

    im pretty sure it would sound fine with just the word court
  • You can leave out the bit where it says which court or if you know your local court name put that in.

    Hello There!

    I have had my claim accepted by moneyclaim and Lloyds have the standard 14 days in which to acknowledge my case.

    Moneyclaim have sent me a letter stating that they will judge the papers as having been served to the bank on the 12th.

    My question is this, do you think that the bank will get extra time to acknowledge my claim because of the Christmas shut down or does the standard time period apply. If the standard 14 day rule applies then that means that Lloyds will only have until Friday 22nd to acknowledge my claim. This is effectively 10 days (8 if you dont include the weekend).

    Could work in my favour?!?

    Hey there

    Well to be truthful, i dont think it will matter, i did the same as you and last Saturday received letter from the courts stating Lloyds acknowledge my claim and want another 28 days to present a defence. Apparently i will need to submit another form when i received more paperwork and go from there... from what i have seen on here, Lloyds tend to drag out these claims!!

    Got to the A Q stage, any suggestions as to what to put in the other information section:confused: , is it just a case of telling the court that you are claiming charges off their information. Or do you say nowt;).What happens next, how long have they got to sort themselves out:confused: Any info gratefully received:T
