    You can claim back any charges in the last six years even if the account is closed now.

    If you don't have a cheque book, you can send a postal order for £10.

    OK decide to go for it. Entered the following at moneyclaim:

    1. The claimant has an account xxxxxxxx with the defendant, opened July 1996. 2. Since 01/09/2005 the Defendant debited charges and interest in respect of purported breaches of contract. 3. Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. 4. Claimant contends: (a) The charges exceed the Defendant's lossess caused by the breaches; (b) The term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. 5. Claimant claims: (a) return of the amounts debited of £xxx.xx; (b) Interest per S.69 County Courts Act 1984 of 8% - £x.xx continuing at 8% until judgement or settlement at a daily rate of £x.xx; 6. Alternatively if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the court.


    Can someone run their eagle eye over it to make sure i've not made any mistakes - template used from the CAG website.

    i wonder if anyone can help me, i've got a claim going on with ltsb i'm at the court stage. i have had an acknoweledgement from the court and they say ltsb intend to defend their time is up on the 12th dec.
    a couple of weeks ago lloyds sent a offer letter of £750 so i sent a letter of refusal as it was only partial payment. but the day after their offer letter the money was put into my account, i have rang mr o'neil and ask for the money to be taken back but it is still sitting my account.
    the really hard thing is trying not to touch the money but it is really hard when the mortgage and bills are coming out the account , and now on top of christmas its getting harder, do you think i could use this money without it harming my case or should i leave it alone.

    Write to the bank and inform them that you will accept the £750 as a part payment without conditions, but you will continue your claim for the balance.

  • my son was charged £70 by lloyds bank TSB when two companies (one of the companies is owned by lloyds TSB ) tried to take the direct debit on the 30th of the month instead of the 1st of the month. how can i get the money back for him.i tried talking to the bank and they are not listening. LINDYLOU
