  • I have gone down the small claims route to get bank charges back and Lloyds TSB have put in a defence. I have 14 days to return Allocation Questionnaire. How much detail do I need to put on the form? Do I have to answer every point that bank has put in it's defence? Will I have to attend a hearing?
    Please help

    I started this thread a month ago - and my chances to get on the internet since then have been few and far between!

    When I logged on today i had no idea how this thread has grown!!

    I have good news ..... i took the advice offered by the early replies to my post and sent Lloyds a LBA ...

    2 weeks later received an offer of £750 :j , I decided immediately to write back and say I would only accept this as partial payment and would continue with action ......

    literally the next day the cheque for £750 arrived:j

    I am now waiting to hear back from my letter asking for full settlement (£1300) ... will keep all informed

    Nothing like this ever seems to work for me - so I am both amazed and so happy. I feel that Lloyds never did take my complaints seriously ( I have been complaining about these charges and the resulting hardship/debts for about 3 years on and off) until i took the advice on here and structured my complaint as everyone else has done. The amount still owed to Lloyds was £700, so that is now wiped off :D and anything else is a bonus really

  • In the presumption that you need to send back your AQ as soon as possible, and the fact that I'm not yet familiar with the information here with regards to bank claims I will suggest going to the consumeractiongroup forum (not sure if it's ok to post a link, so I won't) where if you register for free you will be able to access their library section which will have information on exactly what to put on the AQ and anything else you may need to do.

    This will be a standard defence and so lots of other people would have been down the same route as you and be able to help you out.

    You may also want to check out the specific LTSB section there to read about other people's experiences with them, as each bank handles the claims slightly differently and you will get a good idea of what to expect.

    Obviously you could also search on here for 'Allocation Questionnaire'.

    I know that you do need to answer the points they have raised, although some points you may be agreeing with, such as the fact that you did indeed breach terms and conditions (don't worry this is the entire point).

    You do need to be prepared for going to court just in case (I mention this because you sound nervous about it, it's understandable but you shouldn't worry about it), but there should be enough information probably here and definitely on CAG to help you with that if it comes to it.

    You should have given them a time scale of 40 days in which to send the information so they have to do it within that time.
  • I'm currently going through my list of charges from LloydsTSB, but I am a little confused as to what I should be including e.g. where it says Account charge £7 do I include this? It appears after every O/Draft excess fee, there is also the O/Draft interest, but I guess you leave that out?

    Any advice would be much appreciated, thankyou.
