    If your claim is under £5000 it is very likely it will be kept in the Small Claims track. This means unless there are exceptional circumstances, even if you lost, you wouldn't pay any legal costs.

    If your claim is over £5000, it could be put into the Fast Track court system. This means if you lost, you could be eligible to pay some or all of the defendants costs. The advantage however, is banks are unlikely to want to defend a claim in the Fast Track in case it gets esculated to a higher court and a precedent set.

    The chances of losing in either track are very small, so you just need to weigh up your own situation.

    Ignore their BS tactics and file a court claim. Don't even try to argue on the phone, you won't get anywhere.

  • I got the letter saying Yorkshire Bank were inundated and I could refer them to the Commisioner if I wished, but the statements arrived, probably about 2 weeks outside the time.

    I'm a solicitor and never known that one! Maybe YB have asked for an extension of time.

    Only thing you can do I guess is call on Tuesday.

    If MCOL say you have done everything right then I wouldn't worry too much. Just call on Tuesday and ask them to explain.

    Ordered statements 12/2-2007

    Letter saying they were busy received 22/03/2007 39th day

    Sent letter to Informations Commissioner 26/03/2007 no response from them yet.

    Received 18 months statements 27/03/2007 saying others to follow.

    Wrote another letter to YB 2/04/2007 reminding them of the outstanding statements to date had no more correspondence.

    It sounds like Yorkshire have (deliberately?) messed up to drag this out. Courts for some reason are giving banks slack in some cases and not allowing judgements to be filed. Sit tight until next week.

    Scum bags! I look forward to the challenge to be honest, would expect them to play hard ball. Would be nice if MCOL could put in the letter who CCBC are and perhaps a number! Maybe they use YB for their banking needs!!

    Hi i'm looking for reasurrance and advice really so hope someone can help. Basically i'm trying to claim back £1486 from Llyods TSB, i've gone through each stage as per this site and this is where i'm at.... Llyods offered me £750 in what seemed to be a standard letter they send out i decided it was worth going all the way (i hope this was the right decession?) so sent a letter saying not acccepting etc etc they then put an acknowledgement in to my claim which gave them a deadline of 15th April. Didn't panic to much at this stage but now :eek: i have received notice of proceedings paperwork and their intention to defend the claim so I am now panicing that i am actually going to have to go to court.....
    I need to know what i have to do now went back on mcol to check and it said it's being dealt with by courts now. I've heard about the 'allocation questionare' do i send off for one or will i receive it automatically? Is that the next step for me and do you think they will actually take me to court not sure if i'm brave enough to do that??? Please help!!!!!:o Thanks
