Charges can be reclaimed for both a/c's.
Their is also the possibility the bank would see this as a relationship breakdown and withdraw any financial help in the future.
If there is a business loan this would not be affected as it is a seperate agreement.

I am in a similar situation. Got through to the court section , but the Bank(Barclay's) put in a defense 0n the 4th April, 2 days before the expiry date of the summons. Really cheesed of. It seems they are playing mind games. Even when one has faith in the system it is nevertheless nerve-wracking when one has to wait yet another 14 days. Obviously this is the Banks intention. Plough on regardless I say (while quivering in my boots(which I will be able to afford when they pay up))

I have just carried on and have got to the stage where I have filed a claim against the bank once for me and also for my daughter.

well its the ester bank holls liyods still not responded to my first letter requesting my statements and come the 11th or 12th of april it will be 40days i have givern them so what do i do the??????????? any help plz .....0

I initially wrote to the TSB on 29th January but to date have only received 3 years worth of statements (and that was only following repeated phone calls!!) Eventually the Assistant Branch Manager at our local branch said I should write to him with the details and he would ensure all charges were worked out and were refunded. That was on 12th March. I sent the letter reclaiming the charges stating that for 3 years the amount outstanding was XXX and I expected them to work out the correct amount for 6 years, with interest, and wanted a response within 14 days. I have still heard nothing from the bank. Where do I go from here???

I think you are confusing 2 things here. From the bank's POV you should know how much you are claiming from them.
HOwever, what is stopping you knowing this, and claiming the full amount, is their failure to send you the full 6 years' statements as requested. I suggest that this is what you should be concentrating on, for the moment. Write again requesting the missing statements, and stressing that you will be claiming interest on the period of extra delay which they have caused.
In the mean time, you could still claim for the 3 years you DO know about (you should be able to work this out) and make sure that in all your correspondence you make it clear that you still intend to claim for the period 2001-4 (presuming these are the dates) but that they have, as yet, failed to provide the necessary paperwork as they are required to do.Ex board guide. Thanks for your help. This is the letter I sent to the TSB on 12th March to which I have had no reply. Any other options open to me that you can think of?
I am writing to request that you repay all the default charges that have been applied to the above accounts. I do not believe these charges reflect the true cost Lloyds TSB of going into unauthorised overdraft.
I have encountered some difficulty in obtaining copy Statements from yourselves, (originally requested on 29th January 2007 however to date only August 2001 – October 2001 and December 2001 - June 2003 from the Current Account have been received), but following my conversation with you today, I am happy to accept your reassurance that Lloyds TSB will work out the total amount of these charges, plus as I believe I have been unlawfully deprived of the money, with the statutory rate of interest at 8% from the date of the charge being applied, the amount the court will award.
I therefore ask that you repay me the full amount (relating to all 4 accounts – 1 x current account, 2 x personal loan accounts and 1 x visa account, all of which are still “open”) which has still to be ascertained however please be aware that the amount I have established from the Statements received to date is £1032.60. I have attached a full schedule of the charges and interest, for the Statements I have received to date, with this document.
