Court proceedings would be quicker but there would be an up-front cost.

Got a letter regarding my bank charges:
I am sorry you are unhappy with your bank charges...like any other buisness blah blah we need to cover costs blah blah. I do hope you will see our charges are fair and thats why we are not refunding any of your charges.
If you dont agree with this information you are welcome to call me and discuss this or seek a financial obudsman service. (who??)
Im really scared now. What does this mean? Is it tactics to scare me-its working. I sent the third letter claiming £1467 on 3rd april by recorded delivery. This letter is dated the same date.
Do i need to do anything or wait the 14 days as i stated in my letter.
This is a standard letter, I received the same. Mine arrived after I had filed with the court. I sent a terse letter back saying "May I respectfully remind you that this matter is now subject to the judiciary process" I copied the letter to their solicitors in Brighton, which means that they would be charged for handling it. To cut the story short, I received my money for £1572 very soon after.
Dont be intimidated by any letter they may send - Yes they will be pompous, they will couch their ramblings in legalise and make you believe they have superior knowledge. The fact is, as the results of this site and the good people of this site testify the law is on our side, and we are winning time after time

I am unable to get through on any of these numbers to discuss the progress of my claim, I only have until the 7th May until they close mu file but sent 3 letters now and have had a bog standard reply to the last two and I i cannot seem to be able to get in contsact with anyone. What do you mean until they close your file? Have they sent you a "we won't be refunding anything and this is our final answer" letter? Don't phone them, go to court.Reclaimed thanks to this site:

Hi all very helpful info have just sat and read the last 12 pages, but still have a few questions if anyone can help......
My husband sent the original letter with £10 asking for statements for the last 6 years, but he put the bank account number on it and asked for the "bank charges and any other related credit card charges relating to the account", because he has 2 credit cards with this bank and we wanted to claim for all 3 accounts. He did not include the credit card numbers.
we have since received the bank statement's only, and have proceed with 1st letter for £807.50 plus interest, going to send 2nd letter tomorrow.
1. Was he correct in doing this or does he have to write to a different department for credit card charges?
2. If he was correct, they owe us the statements, how do we proceed with getting the copies?
3. Say they do settle claim, as under £1000, the account is closed, how do they pay you??

Also since receiving the Statements we have discovered the bank over the period of a year have paid over £400, to MANCHESTER OSC EM, that was done without my husbands consent, after he had stopped using the account and was unsuccessfully trying to get it in the black, by going through the CCCS. We have spoke to the bank and been told we have to go to the local branch to find out who the payments where to, does anyone know our rights on getting money back as was given without consent????:mad:

Lastly, even though he had the CCCS set up an agreed payment, they still continued to charge him each month, unknown to him, as he had stopped receiving statements by then!!!!, but suddenly in Jan 04 they closed the account, by then was £552.36 OD, 90% charges, by TFR to CDR??? anyone know what this means???...... where to debt went.?????......
I just find what the bank has done, to be awful, they were still charging him £5 fee per month, just to keep account open and continue to charge him, as he wasn't even using account, they add to £120!!!!:eek:

We Have Just Received Our Last Six Years Statements, Took The Bank 33 Days To Send Them. Not Bad, Good Start.
Our Fees Added Up To £5777.55, If U Add Interest, £8222.58!

Now, Do We Go For Just Under The £5000.00, Or Would Anyone Advise Going For The Whole Lot, With Interest Etc, Because We Feel There Is Quite A Big Difference Between The Charges, Then When We Added Interest On Top. We Don't Want The Bank To Keep The Interest, But
We Keep Reading How, Maybe People Should Not Got For The Higher Amount, As You May Lose, And It Will Cost More.
Does Anyone Have Any Success Stories, Of Going For A Large Amount Like Ourselves.

Yorkshire bank didnt file a defense within the 28 period allowed. I requested judgment by default but it was rejected. I rang MCOL they said YB had not filed a defense and I had done everything right (thanks to moneysavingexpert) but there was a bar on judgement due to Yorkshire bank filling in some paperwork incorrectly. I received a letter from MCOL today that says "Your request for judgment in this claim has been rejected for the following reason: A bar on judgment/enforcement is in place-contact CCBC" Does anyone know why this would happen and who are CCBC? MCOL closed til tuesday so cant ring them now! HELP!:cool:Stick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.

The same thing is happening to my son.Lloyds are charging him £5 a month to keep the acc open when all we want is for them to close it.I'd say every penny of the £210 overdraft is made up of charges and mostly ones that I cant claim back like acc fee and overdraft interest.It makes me mad as it seems that they dont want you to ever pay it off so they just make it harder and harder.Every Little bit you manage to pay off is offset by the charges they put on.Today he had a letter saying,"We wanted you to know that we have taken all the payments that you arranged to come out of your acc yesterday.Unfortunately,because there was not enough money in your acc to cover them,this means your acc is now over your overdraft limit".It goes on to say that they need to let him know as they will charge him for being over the overdraft limit.The point is there are no payments coming out of that acc except the £5 a month that they charge him to have the acc.0
