If you requested all your statements under the data protection act before you think about suing them for your charges you need to sue them to comply with the DPA request - or at least report them to the ICO. The onus of proof that they charged you is on you.LegalBeagles0

My Bank Llyods TSB have charged me 9000.00 in bank charges can i still claim this back in a small claims court,

I am trying to reclaim my Bank Charges £4600 + £560 interest form Lloyds TSB after sending all the letters and waiting for the deadlines I have not recieved a satisfactory response ( just 1 letter saying we are looking into it, will take 4 weeks etc)
As i am on benefits I would prefer to do this in person as (i cannot afford the court fee) at my nearest County Court, hopefully on Tuesday 10th April
Would anyone be able to advise me on what i would need to take with me in order to get the ball rolling?
Any help would be gratefully recieved. Thanks in advance

I would suggest ... just take everything you have.
Your statements (the charges ones)
Your spreadsheet of charges (and interest)
The copy of the letters you sent + the banks reply letters

I have initiated proceedings against Lloyds TSB and Nationwide with one case already transfered to the local court after the Defence was entered. This contained the usual flannel, notification of current charges and notification of such charges etc published and available. Interestingly the statement adds that they dispute the charges as being unlawfull - we'll see.The other case i expect to transfer shortly.
I have prepared schedules on which the claims are brought. At which stage should i consider instructing a solicitor to represent me or is the matter so straight forward in court that i could conduct my own defence. Any previously successfull cases please advise......... hold my nerve. Thanks for any advices.... help!0 -

You don't need to instruct a solicitor. The Small Claims procedure is such that a layman can bring a case without needing to be represented. It is very unlikely your case will actually reach a courtroom. The majority of cases are paid up before this date.0 -
